Saturday morning on August 23rd in Battery Park in Burlington was the perfect summer day backdrop for the final Prevent Child Abuse Vermont’s WALK FOR CHILDREN TO END CHILD ABUSE. Governor Jim Douglas, and House Speaker Gaye Symington were introduced by PCAV’s Board President, Walter Bruska. Also joining in the family-focused festivities were Champ, Mr. Cruller , Dr Lewis First , PCAV’s Big Blue Kid Bear, Cub Scout Troop 620 and many teams and individuals from every corner or the state. Both the Burlington and Montpelier Walks in 2008 were dedicated to the memory of Brooke Bennett, three small infants who died this year from Shaken Baby Syndrome, (abusive head trauma), and three year old Stephen McKay who died from abuse several years ago.
This year over 500 people, raised over $65,000 to help support the many prevention programs offered by PCAV. “I was so pleased with the two walks this year.” said Linda E. Johnson, Executive Director of PCAV. “It was so moving to see such tremendous community support, and with the wonderful weather I was touched to see so many families and friends walking together and smiling in the sunshine. Everyone involved is helping to spread the word about preventing child abuse in Vermont!.”
The WALK FOR CHILDREN TO END CHILD ABUSE is made possible through the generous sponsorships of McDonalds, National Life Group and many other caring businesses.

On June 23, two days before Brooke's disappearance, Chevy Pickup (Jacques online name) instructed Juvenile 1 in an e-mail to have her boyfriend, identified as Juvenile 2, ejaculate on her stomach and wipe up the semen with a "CLEAN, PLAIN" handkerchief, according to an e-mail cited in the complaint.

"Then put the handkerchief into a plastic sandwich bag and seal it up and hide it," the e-mail to Juvenile 2 instructed. A semen-stained handkerchief was found near Bennett's torn underpants the day after she disappeared.

Panel endorses stronger sex laws

MONTPELIER — The Senate Judiciary Committee on Friday approved a handful of recommendations for tightening the state's sex offender statutes, including a recommendation for a new law that resembles the controversial Jessica's Law and has a mandatory 25-year minimum sentence.

If approved by the Legislature, the proposed law would give prosecutors the option of charging an accused sex offender with a new crime: "aggravated sexual assault against a child under 16 with a mandatory minimum sentence of 25 years to life."

The panel's action came during the last in a series of hearings convened in response to the death last summer of 12-year-old Brooke Bennett. At the hearing, the lawmakers heard testimony from a victim of Bennett's accused killer, her uncle Michael Jacques.

Under the Judiciary Committee's proposal, prosecutors would still have the power to negotiate plea agreements, something they feared a mandatory sentencing law would limit. For example, as part of a plea deal they could simply charge an alleged sex offender with a lesser crime.

"It's another formidable tool for the prosecutors," said Sen. John Campbell, vice chairman of the Judiciary Committee.

"When they have a good case … they're going to bring this charge," said panel Chairman Sen. Richard Sears. He said the law, if approved, would fulfill Gov. James Douglas' request to enact Jessica's Law.

Jacques was a convicted sex offender who had served jail time and was released from probation. At the time of Bennett's disappearance and death, many said he was released from supervision too early. That public anger was a driving factor behind the Senate Judiciary hearings and the recommendations approved Friday.

Lisa Frigon, one of Jacques' victims, testified before the committee Friday. The panel then added recommendations for changes to sex offender laws that sprang from Frigon's experience.

Frigon was a 13-year-old in 1995 when she said Jacques took her upstairs in his Barre apartment and raped her. Her experience with the judicial process following the rape was horrifying, she said, and she recounted some of those experiences as she sat before the Senate Judiciary Committee on Friday.

"I'd like to thank you for your time and for inviting me to come speak," Frigon began. "I've waited a really long time to say or share anything about how I feel like my rights as an individual and a victim of 13 years old were traded, if you will, for his rights," she said, speaking of Jacques.

She recounted the horror of sitting across the table from Jacques and his defense attorney as the attorney fired questions at her.

"It was the absolute worst, next to being raped," she said.

Frigon had a victim's advocate with her, but not her parents, she said.

"I went to the deposition and I was up against a very well-seasoned attorney and Michael Jacques," she said.

During that deposition, based on the lawyer's line of questioning, "the inference I got … was as if it was my fault," Frigon said of the assault. She said the attorney implied that because she was at Jacques' apartment, where there was often alcohol and late-night parties, "of course this was going to happen."

"I carry a resentment, probably unfairly, for that lawyer," she said.

Diane Wheeler, a prosecutor who works for the sex-crime Special Investigations Unit based in St. Albans, told the committee that changes were needed to the deposition process that Frigon found so traumatic.

"These depositions are fishing expeditions," she said, in which defense attorney's ask the kind of leading questions that prosecutors could never get away with.

And when the victims are intimidated, prosecutors are often forced to dismiss or amend the charge, she said.

The committee added changes to the deposition process to their list of recommendations, though Sears said the language hasn't been finalized for what those changes would be. He added that he did not approve of changing the deposition rules, but was outnumbered on the committee.

"I'm worried about convicting innocent people," he said.

The committee also decided to include a recommendation that there be no deferred sentences or expunged records for certain sex crimes against minors, which occurred in Frigon's case as part of a plea agreement with Jacques.

Jacques ended up pleading guilty to lewd and lascivious conduct against Frigon.

The new 25-year mandatory minimum option could have been applied in Frigon's case if that option was available at the time, and longer sentences are important, Frigon said.

"How many people's lives are allowed to be hurt before they're put away for a really long time?" she asked the committee.

The committee has a package of recommended changes to state sex offender laws, from fully funding sex-crime Special Investigation Units to preventative measures, such as including a sexual abuse prevention component to school health education programs.

Aside from the 25-year minimum law, other sentencing recommendations are to require pre-sentence investigations and allowing sentencing courts to see a sex offender's sealed juvenile records. Lie detector tests will also be recommended, as will a judicial hearing before a sex offender can be let off probation (unless all parties support the discharge from probation).

Fully funding the Special Investigation Units is a top priority and has an estimated price tag of $1.25 million per year.

The committee will finalize the basic outlines of the proposed changes to the law, have the legislation drafted, and meet in December to give final approval to the draft legislation so the package is ready on the first day of the 2009 legislative session in January.

Lawmakers were pleasantly surprised with how productive they felt the Judiciary Committee hearings were despite early fears that the hearings would be exploited for political gain.

"I thought it would turn into a political circus," said Campbell, who added he was absolutely wrong about that.

Campbell said he learned a great deal about the problems in the system and about victims and what they go through during legal process.

Sears and Campbell agreed that the time the committee spent on the issue means the laws will be enacted at least a year — maybe two — before they would have without the hearings.

"We probably spent more time on this issue during these eight sessions than we could have during a whole legislative session," Sears said.

A tougher stance against sex crimes


Lawmakers in Montpelier hope to amplify the state's new sex crimes law by increasing registry standards online through a new piece of legislation.
Twenty-eight representatives have co-sponsored a House bill designed to increase registration among sex offenders in Vermont, including convicted individuals whose crimes predate the state's new registry conditions.
The proposed legislation also instructs offenders to provide more information to the registry, which in turn is posted on the Internet on the state's Web site for sexual offenses. If implemented, the act would make a greater amount of information available to the public.
Sex offenders will have to make periodic in-person appearances to verify the information contained in the registry remains up to date.
"The registry is a way for parents to know what's going on in their community to better protect their children," said Rep. Patricia O'Donnell, R-Vernon, one of the bill's sponsors. The recently passed sex crimes bill was a good piece of legislation, but the only missing piece to it was Internet registration for offenders, she added.
But the legislation does not stop at just making sex offender information more accessible to the public, the bill also seeks to expand the minimum duration period of registration for sex offenders.
It also calls for offenders who intend to temporarily stay within Vermont's border for a span of
10-plus consecutive days or for 30 days in a 12-month period to register as well.

O'Donnell said much of the legislation is based on the Adam Walsh Child Protection and Safety Act, which aims to synthesize a nationwide sex offender registry online.
Congress passed the measure in 2006, 25 years after Adam Walsh was abducted from a Florida department store and was found murdered 16 days later.
But because of the federal guidelines within the act, Vermont officials have to review the classification criteria to ensure it does not generate a constitutional variance. If lawmakers in Montpelier were to pass the bill as written, Vermont would have to spend millions of dollars to cover legal costs of establishing the new standards.
With this in mind, representatives are looking at the pieces within the legislation that best fits within Vermont's statutes.
"(Congress) wants all the states to pass the legislation or else they're going to withhold certain federal funds," said Rep. John Campbell, D-Quechee, who serves as vice-chairman on the Senate Judiciary Committee.
The problem with the Walsh Act is there is no state yet that can pass it because of the cost and the underlying constitutional issues, said Campbell.
Currently, the state has a more unrestrained online requirement -- only about one-fifth of Vermont sex offenders meet the minimum threshold necessitating them to register online -- than neighboring New York and New Hampshire, which O'Donnell says could cause more offenders to jump the border into the Green Mountain State to avoid certain Internet registration preconditions.
"That to me is unsafe for our families. Our standards should be as strong as our bordering states," she said. "We have to do everything we can to protect our children from these kinds of crimes."
Legislators look to continue to develop stricter policies for sex crimes, building on the state's recently passed Senate bill 13 designed to improve the sexual abuse response system.
Gov. James Douglas signed the bill into law at a public ceremony in Bethel last Wednesday afternoon.
"It was a great cooperative effort of people of all political afflictions," said the governor.
Advocates say the law will provide an extensive focus on sexual violence prevention in schools and communities by educating Vermonters of all ages about the reality of the issue.
The new statute also funds a new Special Investigation Unit, as well as additional protections for victims, designed to make the criminal justice system safer and more accessible for victims of sex crimes.
Officials in the Statehouse pushed for tougher prosecution laws regarding sex offenders after the death of 12-year-old Brooke Bennett, who was kidnapped, raped and murdered by her uncle eight months ago.
"Every year, untreated, violent sex offenders, who are likely to offend again according to Corrections, are released into our communities," and these crime prevention steps would likely have been taken without the tragic incident with Brooke Bennett, said Douglas.
O'Donnell said moving forward on the duplicated Walsh Act will allow the Legislature to continue to work on creating tougher laws for sex offenders.
"My main hope in all of this is that we strengthen the Internet sex offender registry," she said. "I think the best thing the Legislature can do for the communities of Vermont is to protect our children from these predators."

Ex-stepdad of Bennett pleads guilty

The former stepfather of Brooke Bennett, the 12-year-old Braintree girl who allegedly was raped and killed by her uncle in Vermont last summer, has pleaded guilty in a Texas court to transportation of child pornography.

Raymond Gagnon’s guilty plea, entered last week at U.S. District Court in San Antonio, was accepted by Judge Xavier Rodriguez on Monday. Gagnon faces a prison sentence of five to 20 years.

“By my calculations, Mr. Gagnon will end up getting somewhere between 17 and 20 years on this charge,” said Assistant U.S. Attorney Tracy T. Braun in San Antonio.

Brooke Bennett

Brooke Bennett disappeared in June 2008 and her body was found a week later. Bennett's uncle Michael Jacques was charged with the kidnapping. According to an affidavit, an unidentified minor told police that Bennett was being groomed by her uncle to join a sex ring called Breckinridge.

On October 1, 2008, Jacques was indicted on charges of kidnapping resulting in murder and five counts of child pornography. It is alleged that he smothered Bennett with a plastic bag. (Ref. 1)

Michael Jacques and Ray Gagnon
On June 29, 2008, Bennett's uncle, 42-year old Michael Jacques, was arrested on unrelated sex charges involving a minor. The minor was not Bennett but the evidence was revealed in the course of the investigation. On July 1, her stepfather, 40-year old Ray Gagnon, was also arrested with charges of obstruction of justice. Allegedly, both have been previously involved with sexual assault of minors. Cover-Up
Police say that Jacques posted fake messages on Bennett's MySpace page to make it appear as if she had been corresponding with someone she met online. (Ref.2)


Michael Jacques - Age 42

Michael Jacques was arrested during an investigation into the disappearance of his 12-year-old niece, Brooke Bennett. Brooke's body was found buried less than a mile from Jacques' home. Jacques was charged with kidnapping on July 3, 2008.

On Wednesday, October 1, 2008, Jacques was indicted on charges that included five counts of child pornography and kidnapping that resulted in death. The indictment stated that Brooke was smothered with a plastic bag. It is also alleged that Brooke was led to believe that she was being "designated for termination" by a nonexistent child-sex club "Breckenridge," a group Jacques "made up" to threaten her and another 14-year-old unidentified girl. Beginning of Investigation
Jacques was arrested on June 29, 2008, and charged with aggravated assault against a minor. The charges were unrelated to Bennett, but were uncovered during the investigation into her missing persons case. (Ref. 7)

Sex Ring Allegations
On July 2, 2008, federal officials claim that a teenage girl admitted to helping Jacques drop off Bennett at the convenience store. The teen also admitted that she had been part of a sex ring with Jacques called Breckinridge, since she was nine years old. According to the unnamed teenager, Bennett was going to be initiated into the sex ring. Jacques was charged with kidnapping on July 3, 2008. Depending on the cause of Bennett's death, Jacques may face the death penalty for his involvement. (Ref. 11) Jacques will be held in custody until the trial begins on the kidnapping charges.

History of Violence
Despite a criminal track record that included the abduction and rape of an 18-year-old girl in 1992, the Vermont Department of Corrections released Jacques from probation in 2004 on the recommendation of probation officer Richard Kearney. Vermont Governor Jim Douglas has admitted that the state needs to reevaluate its procedures. (Ref. 12)


Ray A. Gagnon

Ray A. Gagnon is the step-father of Brooke Bennett, a 12-year-old girl who disappeared on June 25, 2008. Bennett's body has been reportedly found by Vermont police on July 2, 2008. Gagnon is being held in custody on charges of obstruction of justice in relation to Bennett's disappearance. He asked someone to get rid of his laptop during the search for Bennett. He also attempted to access her MySpace account. (Ref. 13, Ref. 14)

In an unrelated investigation, Vermont police stated that Gagnon sexually assaulted a minor in the Royalton, Vermont area in 2007. Gagnon was arrested for those charges on July 1, 2008. He was charged with child pornography on July 7, 2008. (Ref. 14, Ref. 15)

Brooke Bennett: One Year Later, Part 1

A massive search for 12-year-old Brooke Bennett was underway one year ago this week. That search eventually led local police and the FBI to Michael Jacques, and a shallow grave a mile and a half from his home. One year later the man accused of killing Brooke Bennett is in a federal prison while he and Bennett's family wait for his trial to begin. In the meantime, investigators are still following up on the literally hundreds of leads generated during the search for Brooke.

It was an investigation that started like all cases, with a call to police. This one came on the night of June 25, 2008. Twelve-year-old Brooke Bennett was missing. Within hours the details surrounding her disappearance gave police a feeling that the investigation wouldn't lead to a positive end.

"You know I think a lot of us in the back of our mind had a pretty good sense of where it was eventually going to end up," said Major Ed Ledo of the Vermont State Police.

Police immediately eyed Brooke's uncle Michael Jacques. He was the last person seen with her.

Brooke Bennett: One Year Later, Part 2

Starting today 1,200 new sex offenders will be part of the Vermont sex offender registry. The addition is just part of the massive statewide reform effort that came about in the wake of Brooke Bennett's murder. Word that Bennett's suspected killer is also a convicted sex offender who was released from probation early, prompted calls for immediate review of Vermont laws.

In early 2009 the legislature passed two reform bills that establish special investigative units in every county, ramp up the state's sex crimes prevention efforts, require more people to add their names to the registry, and provide the public more information on the registry.

"It's a generational transformation in the way Vermont approaches sex offenders," said Sen. Dick Sears, D-Bennington, who also chair Senate Judiciary Committee. "There was a tendency when the murder first occurred, and when Michael Jacques was first arrested, there was a tendency I think to overreact. The public called for very strong laws and we provided those, but I think we did it in a very thoughtful manner."

Two men have already been charged under Brooke's Law; the portion of the reform bill that includes 25-year mandatory minimum sentences for sex crimes against children.

Brooke Bennett: One Year Later, Part 3

July 2 marks exactly one year since investigators found the body of 12-year-old Brooke Bennett buried in a shallow grave in Randolph. News of her murder came as a devastating shock to her family who held out hope during the one week search that she would be found alive.

A year later Brooke's parents are still struggling with the reality that she is gone, but both have also channeled their grief toward positive changes.

Her father, Jim Bennett, wears a purple bracelet and a pin bearing a smiling portrait of Brooke every day to keep her close. Purple was her favorite color. Jim says he cannot believe a year has passed.

"I still keep expecting the phone to ring and her be on the other end," he says.

Jim visits his daughter's grave several times a month. It sits alone in a quiet corner of a cemetery in Royalton, marked by a beautiful stone donated by local companies. Friends and family members have left letters and gifts.

Shortly after his daughter's murder Jim established the Brooke Bennett Memorial Foundation. He hopes to raise enough money for a scholarship in her honor and to buy a kit that he can take to schools that will make fingerprint and ID cards for kids.

"It will give me something else to focus on," he says. "And it'll help other people, give them information they may need someday."

The Brooke Bennett Foundation

The Brooke Bennett Foundation was created in memory of Brooke Marie Bennett. The Foundation's main goal is to start a scholarship program at both Randolph Union High School and Whitcomb High School in Bethel where Brooke was a Girl Scout. With the first scholarship being awarded in 2013, the year in which Brooke would have graduated. It also plans to fund a child ID program in the area, which would provide families with a recent photo, finger prints and DNA to have on hand should they ever need it.
