Baby Gabriel's mom quiet about his whereabouts
.... Johnson and Smith have hearings in Maricopa County Superior Court this month. A hearing on the finding that Johnson is competent to stand trial is scheduled for Sept. 23 and 27.
A status conference for Smith, who has been out of jail since March on a $15,000 bond, is scheduled for Sept. 27.

Possible plea deal in Baby Gabriel case fuels uproar
News that Tammi Peters Smith, one of the women at the heart of the Baby Gabriel case, is discussing a plea bargain has triggered a new Facebook page, sent a ripple of posts on some of the 20 others and angered some Gilbert and San Antonio mothers who are against any deal.
It has also prompted Smith, 38, of Scottsdale, to say she will be exonerated.
"The public doesn't know the truth," said Smith, referring in part to many pages of evidence people haven't seen. "Once the truth comes out I will be proved innocent."
Smith is charged with custodial interference and forgery and has a Sept. 27 status conference scheduled in Maricopa County Superior Court.

Judge delays trial date in missing Ariz. baby case
A Phoenix judge on Monday delayed setting the trial date for the mother of an Arizona baby missing since December and the boy's would-be adoptive mother.
Maricopa County Superior Court Judge Paul McMurdie said he'll decide the trial date during a hearing Oct. 25.
Elizabeth Johnson, 24, the boy's mother, has pleaded not guilty to charges of kidnapping, child abuse and custodial interference in the disappearance of her son Gabriel, who was 8 months old when he was last seen in December in San Antonio.
Police don't know whether the boy is alive.
Johnson attended the hearing in her black-and-white jail uniform, chatting with a nearby inmate and her attorneys. She did not speak during the hearing.

The lawyers who represented a woman in the case of missing baby Gabriel Johnson since February no longer will be representing her in future court proceedings because they stated in court documents that she no longer can afford to pay them.

Smith, a Scottsdale resident, has a company, according to published reports, called the Healing Waters Health and Wellness Clinic. Tammi's husband, Jack Smith, 56, was once a big name in Southern gospel-music circles, according to reports that said he was a regular on the Grand Ole Opry, produced music for PraiseHymn Soundtracks and reproduced soundtracks for the Tape Factory.
The Smiths have one adopted daughter, Jack said recently. He said she is the child of a daughter from his first marriage. He also confirmed that he and Tammi are raising a second child from the same daughter.
The Smiths wanted to adopt Baby Gabriel, who lived with them for a week after Gabriel's mother, Elizabeth Johnson, fled from her Tempe home with him in mid-December. His father, Logan McQueary, 25, has not seen him since.

Attorneys representing Elizabeth Johnson, the Arizona mother charged with kidnapping in the case of the missing 8-month-old baby Gabriel Johnson, have accused a San Antonio police detective of wrecking her defense by conducting an unauthorized interview with her.
Police Chief William McManus said the detective did conduct the interview May 10, three months after a police probe here led to a landfill search on the possibility that the baby was killed and thrown in the trash.
But McManus called the defense claims unsubstantiated and said the detective has not been removed from the case.
Arguing that the detective caused irreparable damage to their relationship with their client, attorneys Nick Alcock and Adam Feldman have asked a judge to dismiss the Arizona charges against the 24-year-old mother, who remains in the Maricopa County Jail in Phoenix.

Elizabeth Johnson, Gabriel's mother, and Tammi Smith will next appear in court Nov. 22, where their court-appointed attorneys will be assigned, according to court documents.
Johnson and Smith are scheduled to go to trial May 9 to face criminal charges in the case of the missing child, who has not been seen since December 2009.
