Report on missing baby released by Tempe police‎

A lengthy report released Tuesday by Tempe police describes how investigators have chased false leads from Texas to Florida in the hope of finding a baby missing since December 2009.

However, the 230-page report offers little new information into the disappearance of Gabriel Johnson, who was 8 months old at the time and was at the center of a bitter custody battle between his parents.

Authorities don't know whether the boy is alive.

Tempe police said 24-year-old Elizabeth Johnson originally claimed she killed the baby and later said she gave the child to a couple in San Antonio.

Reports offer new details in case of Baby Gabriel‎

Newly released police reports suggest the couple who were named persons of interest in the case of a missing Valley baby, were on an aggressive search to adopt long before Gabriel Johnson came into the picture.

The case made headlines when Gabriel’s mother, Elizabeth Johnson, told authorities she gave her son away to a random couple at a San Antonio park. According to the police documents, Johnson told investigators Tammi Smith, who had been trying to adopt Gabriel, arranged the meeting between Elizabeth and the couple.

The story grew more bizarre when it was learned that Tammi Smith met Elizabeth at an airport and offered to adopt her baby. According to the reports, that was not the first time she approached a parent asking to adopt a child.

Baby Gabriel Case Not Headed Back To Grand Jury‎

The case against Tammi Smith, the woman accused interfering with the investigation into the disappearance of Gabriel Johnson, is moving forward.

On Monday morning, Maricopa County Superior Court Judge Paul McMurdie denied a motion by Smith's attorney's to have her case sent back to the grand jury.

Smith is charged with conspiracy to commit custodial interference and fraud in the case of missing Tempe baby Gabriel Johnson.

Smith's attorneys had argued that there wasn't enough evidence to charge her in the first place, and last week, they asked the judge to send the case back to them.

Attorney for 'Baby Gabriel's' mom will seek to have case dismissed‎

In less than two weeks, an attorney representing the Tempe mother of missing "Baby Gabriel" Johnson will argue before a Maricopa County Superior Court judge and prosecutors to drop the charges against her and dismiss the case.

Elizabeth Johnson, who told authorities she gave her son away, has also said that she killed him.

On March 1, Attorney Daniel Raynak plans to pick up where Johnson's former attorney Nicholas Alcock left off in contending that her Sixth Amendment rights were violated when Jesus Salame, a San Antonio police detective, interviewed her in jail without her legal counsel present.

For more than a year, Johnson, 24, has remained incarcerated in the Maricopa County Estrella Jail on a $1.1 million cash bond on charges of kidnapping, child abuse, custodial interference and conspiracy to commit custodial interference in connection to Gabriel's disappearance in San Antonio on Dec. 26, 2009.

Judge will decide if detective must testify on jailhouse interview.

A Friday morning hearing to decide whether Arizona attorneys defending the mother of missing baby Gabriel Johnson can obtain testimony from a San Antonio police detective will be the latest act in a legal drama that began here the day after Christmas 2009, when the boy was last seen....

.... SAPD Detective Jesse Salame interviewed Johnson in May at the Arizona jail in connection with the SAPD homicide investigation, and her defense attorneys cried foul in October. In a motion to dismiss the Arizona charges against her, they contended Salame violated Johnson's right to an attorney and destroyed her attorney-client relationship.

The motion also alleges he went ahead with the interview against the opposition of a deputy county attorney there. Arizona authorities have not spoken publicly about the case.

The Friday hearing before state District Judge Philip Kazen is to determine if Salame must appear in Arizona to answer questions under oath by Johnson's current attorneys. The lawyers who filed the motion since have withdrawn from the case.

SAPD loses round in Baby Gabriel case‎

A judge here Friday ordered a San Antonio police detective to be deposed in Arizona by lawyers for Elizabeth Johnson, 24, the mother of a baby who went missing in San Antonio in late 2009.

State District Judge Philip Kazen said SAPD Detective Jesse Salame must respond to a subpoena filed by attorney Daniel Raynak, who's defending Johnson against Arizona charges of kidnapping, child abuse and custodial interference in connection with the disappearance of her son, Gabriel.

Judge grants subpoena for SAPD detective's jailhouse interview with baby Gabriel’s mother

A district judge granted a request for a subpoena - sending a San Antonio Police Department detective to Arizona to talk under oath about his jailhouse interview with the mother of missing baby Gabriel.

The judge also ruled Detective Jesse Salame will have to turn over a taped copy of the interview to the defense at least ten days prior to his deposition.

Salame conducted the interview with Elizabeth Johnson last summer during which Johnson allegedly told Salame she killed her baby.

She has since told investigators she gave the baby away to strangers in San Antonio.

Johnson’s attorney said the interview was unauthorized and illegal.

Judge upset with Tempe woman's refusal to appear in court in case of her missing baby boy

The judge presiding over the case of a Tempe woman and her missing baby is upset with her refusal to appear in court.

Maricopa County Superior Court Judge Paul McMurdie told Elizabeth Johnson's attorney Tuesday that he wants and expects her to be in court.

The Arizona Republic says Johnson has made only about 90 percent of her court appearances since her arrest more than a year ago.

The county Sheriff's Office says it needs a court order to force a defendant into the transport van and McMurdie hasn't issued one yet.

Groupon Pulls Promotion for Defendant in the Johnson Baby Disappearance

Today Groupon canceled a discount promotion at the Healing Waters Health and Wellness Clinic owned by Tammi Smith, a woman charged with the disappearance of the baby, Gabriel Johnson.

According to police, Smith committed forgery and conspiracy to commit custodial interference in the case of the missing baby who disappeared in December, 2009 and may have been murdered by his mother. Smith had been in talks to adopt the baby.

The Groupon promotion for the clinic was met with criticism and negative feedback, with several people stating that they were going to cancel their subscription to Groupon. In response, Groupon determined that it was best to pull the promotion and issued the following statement.

“Unfortunately, we are no longer able to offer the deal for the Healing Waters Clinic,” a customer support representative commented on the site. “After speaking with the merchant, and due to customer feedback, we have decided to cancel this offer.”

The missing eight month old infant was last seen with his 23-year-old mother, Elizabeth Johnson in San Antonio where she stayed at two motels between Dec. 22 and 27, 2009.

Judge Orders Detective's Baby Gabriel Testimony‎

Jurisdictional battles between two groups of people seem to be hampering the investigation into the case of a missing infant whose mother is refusing to show up for court appearances from her jail cell. Elizabeth Johnson has been in Arizona jail for 15 months and no trace of her Baby Gabriel has been found.
A Texas judge has ordered a Texas detective to testify at a hearing in the case in an Arizona court, but that ruling may be appealed.

Johnson has given conflicting statements to police in the case, one time saying she killed the 8-month-old boy and at other times saying she gave the boy to a couple.

Judge Philip Kazen ruled that San Antonio police detective Jesus Salame must testify about an interview that he conducted with Elizabeth Johnson at a Maricopa County jail in Arizona. Johnson's attorneys were not present at the interview.

Judge Orders Elizabeth Johnson to Appear in Court‎

The mother of a missing baby is due in court and this time, a judge wants to make sure she shows up.

In March, Elizabeth Johnson refused to come out of her cell for a hearing.

The judge warned that if she didn't appear at a future court date, a deputy would force her out of the cell to get her to court.

Johnson is accused of kidnapping her baby son Gabriel back in 2009. She also faces charges of custodial interference.

She claims she gave the boy to a couple she didn't know in San Antonio. Gabriel hasn't been seen since.

On April 12's court date, Johnson did not appear. The next hearing is May 2.

Baby Gabriel case: Attorney won't talk about reported confession‎

The attorney for Baby Gabriel' s mother has in his possession the controversial taped interview between his client and a San Antonio detective.

But he declined to answer the burning question: Did Elizabeth Johnson confess to murdering her son, as the detective has claimed?

"My comment is I am not going to comment on anything in the tape," said defense attorney Daniel Raynak.

The substance of the recording and the upcoming deposition with San Antonio Detective Jesse Salame were key topics during a Tuesday status conference for Johnson, 25, of Tempe, who again declined transport to the courthouse.
