Terri Horman willing to agree to immediate divorce, with delay in settling custody to avoid self-incrimination

Terri Moulton Horman and Kaine Horman met in family law court for the first time today since Kaine Horman filed for divorce and obtained a restraining order against his wife.

Terri Horman's divorce attorney, Peter Bunch, asked the judge to hold the divorce proceedings in abatement while the criminal inquiry proceeds, but Kaine Horman's attorney is fighting any delay.

Bunch argued that a parallel civil divorce case, while the criminal investigation proceeds into Kyron Horman's disappearance from Skyline School, would jeopardize Terri Horman's Fifth Amendment rights not to incriminate herself.

Judge delays Terri and Kaine Horman's divorce proceedings until January, agrees Terri faces 'substantial legal risk'

Multnomah County Circuit Judge Keith Meisenheimer delayed the Horman couple's civil divorce, agreeing with Terri Moulton Horman's lawyers Thursday that she faced "substantial legal risk" if it were to proceed while the criminal investigation into Kyron Horman's disappearance is ongoing.

Meisenheimer found there's "substantial overlap of evidence" between the divorce case and the criminal inquiry and parallel proceedings could create a discovery nightmare. But he said he also had to balance Terri Horman's constitutional rights with Kaine Horman's right to a prompt resolution of custody, parenting, property and financial matters.

The judge sought a middle ground, ruling the divorce would be stalled until Jan. 6 -- not granting the two-year abatement that Terri Horman's lawyers had sought but also refusing to allow the divorce case to proceed immediately, as Kaine Horman's lawyer had urged.

Multnomah County Sheriff's Office plans to search Sauvie Island again for Kyron Horman

Multnomah County plans another search of Sauvie Island this weekend to look for Kyron Horman, who disappeared more than four months ago.

The county’s search and rescue crew will be there along with other agencies and nonprofits groups that have supplied volunteers, said Lt. Mary Lindstrand, spokeswoman for the sheriff’s office. It’s not yet clear who will be in charge of the effort with the head of the county’s search and rescue, Sgt. Diana Olsen, recuperating. She was hit by a suspected drunken driver Thursday night on Interstate 84.

Lindstrand said searchers are likely to comb the same areas of the island as last weekend when dozens of people on foot, ATVs, horseback and with dogs tromped through fields and hacked through blackberry bushes.

PORTLAND, Ore. -- The stepmother of Kyron Horman wants supervised visitation of her 22-month old daughter, as she battles her estranged husband in a divorce case.

Terri Horman hasn't seen her daughter since her Kaine filed for divorce and a restraining order in late June, amid a search for his son Kyron, who disappeared from Skyline Elementary and remains missing.

Searchers continue to comb Sauvie Island today in Kyron investigation despite rain

A total of 80 searchers returned to Sauvie Island today for the second day of the second consecutive weekend in the search for Kyron Horman, the missing boy who disappeared four months ago.

Multnomah County Sheriff's Department spokeswoman Lt. Mary Lindstrand said searchers on the ground, horseback and with dogs were on the island despite the wet weather.

"They have the appropriate rain gear," Lindstrand said. "It just makes it a little more miserable."

Terri Moulton Horman seeks regular visits with her daughter Kiara‎

Terri Moulton Horman is seeking regular and frequent contact with her 22-month-old daughter Kiara, whom she hasn't seen since her husband left the home with the girl June 26 and two days later filed for a restraining order and divorce.

In a motion filed in Multnomah County Circuit Court this week, Terri Horman's attorney Peter Bunch argues that his client is the primary caregiver for Kiara. He says he'll offer expert testimony about the importance of Kiara's well-being of maintaining a relationship with her mother.

Terri Horman "is not in a position at this time to testify on her own behalf in support of an award of custody and parenting time," her lawyer said, because of the ongoing criminal investigation into Kyron Horman's disappearance.

Kyron task force will take fresh look at investigation‎
Sheriff says leads will be prioritized in missing boy case

A 20-member task force has been formed to continue investigating the disappearance of Kyron Horman.

Multnomah County Sheriff Dan Staton outlined operations of the task force Thursday morning during an appearance before county commissioners. The commission approved $209,656 to help pay investigative costs, which Staton said totaled more than $1 million.

Terri Horman details visitation request for daughter Kiara‎

In the motion, Terri's divorce lawyer Peter Bunch says that Kaine had refused repeated requests by Terri to be able to visit Kiara, until a recent divorce hearing when he seemed amenable to supervised visitation.
"There should be regular and frequent contact between Kiara and her mother," Bunch wrote.
Terri also argues via her lawyer that Kaine should pay for whatever form of supervision might be granted. He broached the subject, the motion says, and Terri can't pay as she "is not employed and has no income or significant assets."
Bunch also argues that Terri cannot speak on her behalf, but an expert could detail to the court how important it is for her to have visitation rights, and that supervised ones can be safe and secure for Kiara.
"As the court is aware, because of the ongoing criminal investigations that are focused on (Terri), there are serious issues involved as to (Terri's) ability to assert her custodial and parenting rights."
Copies of the motion were also sent to Stephen Houze, Terri's criminal defense lawyer, and Laura Rackner, Kaine's divorce attorney.

Kyron's parents raise search funds at Roloff pumpkin patch‎

While thousands of people packed the Roloff Farm in Helvetia Saturday to search for the perfect pumpkin, Kaine Horman and Desiree Young continued the search for their missing son.

Kyron Horman disappeared from Skyline School on June 4th. His parent’s hoped to raise awareness about their missing son and to raise money for search efforts.

Amid pumpkins and petting zoos, there was a booth selling Kyron t-shirts, dog tags and posters. There was also a booth for families to create child identification kits.

The family was very familiar with the pumpkin patch; they had taken Kyron pumpkin picking at Roloff Farm in years past.

"He loves little pumpkins," said Desiree. "Kyron loves to come and pick out just the right pumpkin, just the right size. So we got one for him today and we're going to go put it out at the Wall of Hope."
