Baby killed in Gary, Ind., carjacking



GARY, IN (WLS) -- A person of interest is being questioned in a fatal carjacking, according to Gary, Ind. police.

Officials are not labeling that person as a suspect, but said the 33-year old was taken into custody in Portage, Ind., on a traffic warrant. Police will not say how he's related to the carjacking in downtown Gary. Gary's mayor called the man an "extreme" person of interest.

Kwana Shaw, 29, was loading her 13-month-old baby into the backseat of her SUV when she was shot around 7:30 p.m. Monday. Shaw is hospitalized in critical condition and is expected to undergo surgery. Her son, Josiah, was killed.

Gary police and a citizens group hope drawing more attention to last week's shooting death of a 13-month-old Schererville baby will elicit more information in the case.

The Concerned Citizens Against Violence in Gary picketed Thursday at the corner of 21st Place and Virginia Street, the scene where police say someone shot 29-year-old Kwana Shaw and drove off in her sport utility vehicle with her son inside. The boy was later found with gunshot wounds inside the vehicle at another location in the city.

Mother grieved by lack of justice
No charges yet 2 years after carjacking and shooting killed toddler

Kwana Shaw had a lot of plans for her baby Josiah. Though her son was young, like many parents she began to picture where he would go to school and the kind of person he would become.

But, she lamented recently, "Those dreams have been robbed."

For more than two years, she and her family have been waiting for justice for whomever stole them.

On Jan. 28, 2008, Shaw was buckling her son into a car seat in her SUV in the 500 block of West 21st Street in Gary when a man approached and shot her. Police later found the boy wounded in the SUV at the intersection of 17th Avenue and Virginia Street. He died from gunshot wounds to the chin and pelvis.

The crime shocked even the violent-numb in the city and region, and ignited intense vows of justice from public officials.

But despite the urging of Gary's mayor and multiple attempts by authorities to get charges, the years of quiet in the case have frustrated Shaw and her family.

"I'm more confused," Shaw said. "What do you need?"

Especially troubling, she said, is that whoever shot her and killed her son "(gets) to continue their lives. I'm still waiting."

Donna Shaw, Kwana's mother, is the hard edge to her daughter's gentler appeal. She chastised Lake County Prosecutor Bernard Carter's office for not keeping the family updated on the homicide case.

"They're not doing anything," Donna Shaw criticized. "What is the holdup?"

The holdup, Carter said, is a case he does not believe is solid enough yet to bring charges.

"At this point, the case still needs work and additional information," Carter said. "I've got the best minds in the office (working on it). We're not giving up on it."

In the days after the 2008 crime, Gary police questioned the boy's father, Terry L. Bethel, and named him a person of interest in the case. Bethel has not been charged in the shootings.

Kwana Shaw did not elaborate on a civil lawsuit she filed in July against Bethel and his brother Joe Noel, alleging the two caused Josiah's death.

The men's lawyer, Scott King, did not return a call seeking comment last week.

The Shaws' hope for charges was renewed a few weeks ago, when Donna Shaw saw Gary Mayor Rudy Clay at a funeral. After discussing the case, Clay later joined police Detective Lorenzo Davis in Carter's office, although prosecutors again chose not to proceed.

"We think we solved this case, and we presented it to the prosecutor, but they won't accept it," Clay said.

Clay said he and Davis suggested prosecutors present the case to a grand jury for possible indictment.

"Let the people decide if there's enough evidence to prosecute," Clay said.

Davis could not be reached for comment.

Kwana Shaw made a direct appeal to anyone who may know anything about the shooting that severely injured her and stole her young son's life.

Come forward, she said, "if you call yourself a human being."
