Kyron's stepmom 'disturbed'‎

The father of a Portland-area boy who disappeared nearly five months ago has argued in newly filed court papers that his estranged wife is "severely emotionally disturbed" and should not have contact with the couple's daughter.

Kaine Horman alleged in documents filed Monday that Terri Horman is an alcoholic who suffers from an "undiagnosed personality disorder" and that giving her custody of their 23-month-old daughter, Kiara, could endanger the child.

Terri Horman "has historical problems with the abuse of alcohol, which have impaired her functioning since Kiara's birth," Kaine Horman wrote. "Often, (Terri) would pass out on the couch around 7 or 8 p.m. after drinking heavily and would wake up on and off for the rest of the night."

He said in July that Terri Horman suffered from postpartum depression after Kiara's birth.

Neither Kaine Horman's attorney, Laura Rackner, nor Terri Horman's attorney, Steven Houze, immediately returned phone calls Tuesday.

Kaine Horman has repeatedly alleged that Terri Horman had something to do with the June 4 disappearance of 8-year-old Kyron Horman from his school in a rural Portland area.

Terri Horman is the boy's stepmother and was the last person to see him on June 4.

Authorities have focused on Terri Horman during their investigation into the boy's disappearance, but they have not called her a suspect or a person of interest.

Terri Moulton Horman withdraws motion seeking parenting time with Kiara

Terri Moulton Horman's attorneys have suddenly withdrawn their motion seeking parenting time for their client with her daughter after her estranged husband's lawyer informed them that they would face extensive discovery, "multiple depositions" and subpoenas for their client's medical records.

"Respondent's decision to defer this matter is in no way an agreement to maintain the status quo with Kiara," wrote Peter Bunch, Terri Horman's divorce attorney, in a motion filed Tuesday. "Respondent wishes only to act in Kiara's best interest. Respondent does not, and will not, give up her right to seek legal custody and unfettered contact with Kiara. Petitioner's efforts to withhold all parenting time is completely contrary to Kiara's healthy development. However, under all of the circumstances, issues regarding parenting time will need to wait for another day, when additional facts can be obtained and presented."

Latest twist in high-stake divorce proceedings

Days after accusing Kaine Horman’s attorneys of unethical conduct,Terri Horman’s attorney has withdrawn the court request that led to the charge.

On Tuesday attorney Peter Bunch asked the Multnomah County Circuit Court to dismiss Terri’s request for supervised visits with her and Kaine’s daughter, Kiara. Kaine took the child from their home shortly after his son Kyron disappeared on June 6 and obtained a restraining order prohibiting Teri from seeing her.

'Dateline' to air new Kyron Horman program

A new Dateline NBC will explore the latest developments in the Kyron Horman case.

The show airs November 11 and will feature interviews with parents and kids from Skyline Elementary, where the 7-year-old was last seen on June 4.

Reporters will also interview a friend of Kyron's step-mom Terri Moulton-Horman. The largest missing person search in Oregon's history has so far turned up no suspects.

The stepmother of missing Oregon boy Kyron Horman has withdrawn her request for visitation with her two-year-old daughter, Kiara.
Terri Horman's attorneys made the move last week after lawyers for her estranged husband Kaine told them that they would face extensive discovery, "multiple depositions" and subpoenas for their client's medical records.
In his motion, Terri's divorce attorney Peter Bunch wrote:

Though a judge already agreed to dismiss Terri Moulton Horman's motion to seek parenting time with her daughter, Kaine Horman's lawyer filed a 10-page response, threatening to ask the court to sanction Terri Horman if she refuses to testify in the pending divorce and child custody case.

"While Mother may choose not to participate in any meaningful way in these proceedings, her silence will not come without consequences,"wrote Kaine Horman's lawyer, Laura Rackner. "The fact that Mother's own attorney has advised the Court that Mother intends to plead the Fifth speaks volumes about what Mother has to hide...One can only infer that Mother will not speak because her testimony will lead to criminal liability for Kyron's disappearance."

The legal war of attrition in the divorce of missing Portland boy Kyron Horman's father and stepmother continued as more documents were filed in court Friday.

Attorney's for Kaine Horman filed a response to his estranged wife Terri Moulton Horman's withdrawal of a request to seek visitation with the couple's young child last week. In it, they argue that Terri's attachment of a "declaration" was only an attempt to "blame Father and his lawyer for Mother's situation," and that there was no legal need for such statements.

Kaine wants Terri to lose the silence‎

Terri Horman has indicated that she plans to invoke her Fifth Amendment rights against self-incrimination. However, Kaine's attorney contends she is still able to testify about anything that would not incriminate her.

Kaine's attorney states the fact that Terri is considering taking the fifth speaks volumes and suggests that she did, in fact, have something to do with Kyron's disappearance. In the court filing, Kaine's attorney said "one can only infer that Mother will not speak because her testimony will lead to criminal liability for Kyron's disappearance."

It is important to note that while investigators have focused on Terri Horman in connection with Kyron's disappearance, she has not been charged or been named as a suspect in the case.
