Jozlynn's mom loses temp custody of son

GRAND RAPIDS, Mich. (WOOD) - The mom of Jozlynn Martinez, the 2-year-old girl whose body has not been found, showed poor judgment when she allowed an alleged killer to remain in her home, despite concerns he was abusing her children, the state alleged in a court document obtained Thursday by 24 Hour News 8.

Connie Martinez "was concerned that Mr. Malmberg was abusing the child, but allowed him to remain in the home," the state wrote in a petition. "She was also aware that he was using drugs and did nothing to remove him from the home."

A Kent County court referee Thursday ruled the state should have temporary custody of 7-month-old Bryan Malmberg, the son of Martinez and Malmberg.

Court records: Jozlynn Martinez's mother suspected abuse before little girl went missing.

GRAND RAPIDS -- The mother of 2-year-old Jozlynn Martinez suspected her live-in boyfriend Jeffrey Malmberg might have been bruising the child in the days and weeks before the little girl went missing, court documents show.

On Thursday, Kent County prosecutors and Child Protective Services used Jozlynn's mother's own admissions as reason to keep Consuela Martinez's second child in protective custody at least until April.

Jeffrey Malmberg has been charged in the death of Jozlynn, after police say he admitted to kneeling on child's chest until she stopped breathing on Feb. 22, then dumping her body in a garbage bin near the West Side home he shared with Martinez.

On Monday, authorities continued their search for any evidence that may lead them to the body of 2-year-old Jozlynn Martinez, who disappeared last month. Malmberg set to appear in court Tuesday‎

GRAND RAPIDS, Mich. (WOOD) - Prosecutors planned to use Jeffrey Malmberg's own words against him in a hearing to determine whether he should stand trial for killing 2-year-old Jozlynn Martinez.

Malmberg was in Grand Rapids District Court Tuesday for a preliminary hearing in the Feb. 22 death.

Kent County Assistant Prosecutor Chris Becker said he planned to play portions of tape-recorded interviews conducted by police in which Malmberg allegedly confessed the crime.

Man to face judge in girl's disappearance‎

GRAND RAPIDS, Mich. (NEWSCHANNEL 3) – A man who is accused of killing a 2-year-old girl will face a judge Tuesday.

Jozlynn Martinez disappeared from her Grand Rapids home just over a month ago. A few days later the man police believe took her told them the little girl was dead.

A judge will decide if there is enough evidence to send Jeffery Malmberg to trial for the death of Jozlynn Martinez.

Jeffrey Malmberg gives up parental rights to son as he faces murder trial for killing 2-year-old girl

GRAND RAPIDS -- Jeffrey Malmberg, accused of suffocating his girlfriend's 2-year-old daughter then putting the body in a Dumpster, relinquished his parental rights Wednesday to his 8-month-old son.

In a brief hearing before Kent County Circuit Court Judge Nanaruth Carpenter, Malmberg voluntarily terminated his rights to Bryan Malmberg.

Malmberg is awaiting trial on a second-degree murder charge for allegedly killing Jozlynn Martinez in the Nagold Street NW home he shared with Consuela Martinez, 22.

Connie Martinez's son to remain in foster care

Today the girl's mother Connie Martinez was back in court for a child custody hearing. Her 7-month old son, fathered by Malmberg, was placed in foster care during the investigation. The court ruled today that he must stay in foster care for now.

Mother of girl allegedly killed by boyfriend agrees to treatment plan, waiting months for decision on custody of other child

GRAND RAPIDS -- Consuela Martinez, the 21-year-old mother whose boyfriend allegedly killed her 2-year-old daughter in February, must wait at least 90 days to see if the state will reunite her with her surviving 8-month-old son.

Martinez agreed Friday to participate in a treatment plan to better her parenting skills, prevent substance abuse in her life, make a safe home and develop a supportive network of family and friends.
