‭Following the interrogations in the "Joana case" that were carried out at the PJ in Faro, three inspectors stand accused of the crime of torture, one stands accused of failing to assist and omitting a denunciation, and a fifth one stands accused of forgery of a document.

‭In one of the most recent trial sessions, at the Court of Faro, Leonor Cipriano altered her statement and attributed the little girl's death to her uncle, João Cipriano, who said he convinced her to hand her daughter over to a family, in exchange for financial compensation.

‭The next session of the trial over the alleged aggressions against Leonor Cipriano by Polícia Judiciária inspectors is scheduled for the 20th of February.

Cipriano Case: Mystic lawyer requests searches

Leonor Cipriano's Lawyer, sent a fax to the GNR of Portimão in the late afternoon of yesterday, calling for searches to be done in "an abandoned house up there, in the mountains of Figueira," where the mother of Joana [convicted for murdering Joana] says that her brother João Cipriano buried the the corpse of the eight year old girl.

Aragão Correia sent a fax last week to the GNR of Portimão where he requested for the authorities to search in an area pointed out by Leonor Cipriano as the place where her brother João had buried the eight year old girl's body.

Leonor last Tuesday, at the Odemira prison changed again the version of the events surrounding her daughter's murder; she affirmed that "the assassin João Cipriano told her that he had buried the girl's body in the hills of Figueira" in an "abandoned house".

The representative of the mother of Joana in the alleged assault involving current and former inspectors of the Judiciary Police, to obtain a confession from Leonor Cipriano - though Leonor had signed the confession previously to the alleged date of the assault - stressed in that letter that its constituent 'guarantees' the statements of her brother [and uncle of the girl] in those days "which succeeded the disappearance [September 2004].

Even so, according to Correio da Manhã Marcos Aragão Correia and an unnamed friend, along with "a labrador dog trained to hunt" took the private initiative of digging a few holes with a hoe and a shovel in some of the abandoned houses in the hills on the Northern area of Figueira.

Nothing was found.

Cipriano Case: No Evidence Against Gonçalo Amaral, says Lawyer

Gonçalo Amaral’s lawyer in the case of the alleged aggressions against Leonor Cipriano has stated today that “solid proof” was never produced in court, concerning the omission of denunciation of criminal facts, and false testimony by the former inspector.

The trial into the alleged aggressions against assistant Leonor Cipriano by Polícia Judiciária (PJ) inspectors is back in the court of Faro on Wednesday and the start of the session is scheduled for 9.30 a.m.

“There was never solid proof produced in court that Gonçalo Amaral had any knowledge of criminal actions. I never noticed that anything whatsoever was proved about this accusation”, António Cabrita told Lusa Agency.

In this judicial case, former PJ inspector Gonçalo Amaral stands accused of the crime of false testimony and omission of denunciation.

According to António Cabrita, the Public Ministry (PM) used “two weights and two scales” when it accused Gonçalo Amaral of omission of denunciation and did not also accuse the director of the Prison of Odemira of the same crime.

“The director said she found Leonor Cipriano with lesions and had photographs taken, but the first thing that she should have done is to demand an inspection by the Forensics Institute in order to verify the lesions [of Leonor Cipriano] and to describe them”, the lawyer argued.

The defense of the inspectors indicted for the alleged aggressions to Leonor Cipriano is going to request an adjoinment to the process of another analysis to a diskette which reaffirms the conclusion regarding the ‘manipulation’ of the images where Joana’s mother appears with haematomas.

The request of the lawyers of Leonel Marques, Paulo Pereira Cristóvão, Paulo Marques Bom and António Cardoso will be delivered, today in another session of ‘Case Joana’ trial, at the Court of Faro, given that ‘the correct, exact and complete digital forensics analysis is crucial.’

Photos are not Trustworthy

In the report elaborated by the computer forensic expert Filipe Custódio, to which the news agency Lusa had access, concluded that ‘the images presented in the diskette, identified as Photo 1 to Photo 20 (…), cannot be constituted as a trustworthy document’. Therefore, we reiterate that the Photos were Leonor Cipriano shows haematomas in different parts of the body ‘are completely put into question in its authenticity, for the lack of a date, for the evidences of software tampering, and for not being possible to reproduce in a reliable manner the ‘chain of custody’, since their capture up to their presentation in an digital format’.

“Public Ministry doesn’t recognise mistake in order to save its skin”

Accused former inspector believes in aggressions against Leonor Cipriano, but not by these arguidos

Former Polícia Judiciária inspector Paulo Pereira Cristóvão considered, this Wednesday, that the Public Ministry didn’t recognise its “mistake” in accusing him of torture against Leonor Cipriano in order to “save its skin”, says Lusa.

“I see the Public Ministry trying to save itself from a complicated situation that it got into and I think that today our innocence was exhaustively clarified, as well as the mistake in which the Public Ministry has laboured for a long time. We thought that it would be brave enough to recognise that it was deceived, but apparently it kept its stance, trying to save its skin”, he said upon leaving the court of Faro.

After all parties presented their closing arguments, Cristóvão also said that he wasn’t shocked when the assistant from the Lawyers’ Order, Rodrigo Santiago, called the arguidos criminals and demanded their condemnation. “If I was a drug dealer and paid him 100.000 euros to defend me, he would say the same about the other party. I don’t take that into account”, he replied.

The former inspector considered that “there were things today, during closing arguments, that were demonstrated”, namely that “Mrs Leonor Cipriano was aggressed, but they’ll have to think that these PJ members had been in the Algarve for two days and are now being accused of aggressions that the State’s expert herself says could have happened 21 days earlier”. “According to this, I don’t know how justice can be done by sustaining any type of accusation”, he added.

Pereira Cristóvão further admitted that “there were bits that were hard to endure, namely hearing certain lies that were told here by members of the Prison Services’ Directory and then they came over to apologise, on the stairs [outside], for what they had just said”.

“That didn’t exactly happen because they told the truth. The only person who was humble and decent and came here to say the truth, is being persecuted right now with a disciplinary process”, Cristóvão regretted, referring to prison guard António Maia, who said it didn’t seem to him that Leonor Cipriano was aggressed.

Gonçalo Amaral’s defence requests acquittal

Today [yesterday], the defence has asked for the acquittal of Gonçalo Amaral, a former Polícia Judiciária inspector, from the accusation of omission of denunciation and false testimony in the case of the alleged aggressions against Leonor Cipriano, as it considers that proof was not made during the trial.

In his closing arguments, that took place in the Court of Faro today [yesterday], Gonçalo Amaral’s lawyer, António Cabrita, told the jury tribunal that the accusation “failed to demonstrate beyond the shadow of a doubt”, the crimes of which the coordinator of the investigation into the disappearance of Joana Cipriano is accused.

“Mrs Leonor Cipriano, with all the credit that she may merit, and she merits none, said she didn’t see who aggressed her. Then she said it was Gonçalo Amaral. If she didn’t see, why did she take part in a line-up, during which she identified persons who don’t belong to the PJ and were not present at the date of the facts?”, Gonçalo Amaral’s lawyer questioned in his closing arguments.

António Cabrita further defended that there could be no crime of omission of denunciation because Gonçalo Amaral “had no obligation to report something different from what his collaborators reported to him”.

The lawyer also defended the accusation of false testimony because Gonçalo Amaral “naturally believed that what had been reported to him by his collaborators was true”.

“You can only acquit all of the arguidos and especially the one that I defend”, concluded the lawyer, who denounced contradictions in Leonor Cipriano’s statements, questioned the veracity of the photographs of the bruises that had been presented by the accusation and stated that “the only witness who spoke the truth, prison guard António Maia, was hit with a disciplinary process”.

António Cabrita thus followed the defence line of the three Judiciária inspectors who stand accused of the crime of torture against Leonor Cipriano, who had earlier requested the acquittal of the arguidos by the jury tribunal, based on “manipulation” of the photographs and witness contradictions, as well.

The trial of the five Polícia Judiciária (PJ) inspectors, who stand accused of alleged aggressions against Leonor Cipriano within the “Joana case”, returned to the Court of Faro this [yesterday] morning for closing arguments.

The reading of the sentence has been scheduled for the 22nd of May, at 2 p.m.

The process of alleged aggressions against Leonor Cipriano by PJ inspectors is related to the so-called “Joana case”, which dates back to the 12th of September 2004, the day when the eight-year-old girl disappeared from the village of Figueira, Portimão, in the Algarve.

The Public Ministry’s accusations against five Judiciária inspectors and former inspectors appeared following the questioning sessions at the PJ in Faro in 2004, at a time when Leonor allegedly appeared with lesions to her face and body, at the Prison of Odemira, where she was under preventive custody.

Joana’s mother, Leonor Cipriano, and her uncle, João Cipriano (both siblings) were condemned by the Supreme Court of Justice to 16 years in prison each, over the crimes of homicide and concealment of the child’s body.

Gonçalo Amaral refused to answer lawyers

Policemen who stand accused of beating Leonor Cipriano will sue Marinho e Pinto

Former Polícia Judiciária (PJ) inspector Paulo Pereira Cristóvão intends to sue the head of the Lawyers’ Order, Marinho e Pinto.

He believes that the lawyer has acted out of self interest in the trial in which, together with four other policemen, he stands accused of possible aggressions against Leonor Cipriano, the mother of the girl that was murdered in the Algarve in September 2004. Marinho e Pinto was also the journalist who denounced, in weekly ‘Expresso’, the alleged beatings that Leonor, who has been condemned over the murder, suffered during police questioning.

“I don’t forget this gentleman’s [Marinho e Pinto] role in this whole process. It was him who showed the photos [of Leonor Cipriano with violence marks on her face and back] that were under judicial secrecy, in Expresso in 2005. If they were secret, I don’t understand why he hasn’t been summoned to tell how he obtained them, until now”, Paulo Cristóvão added. The head of the Lawyers’ Order constituted the order as an assistant at the beginning of the trial, which seats four policemen from the PJ’s Heavy Crime Unit and former inspector from the Portimão Department, Gonçalo Amaral, on the defendants’ bench. “Marinho e Pinto is a hypocrite, because he has constituted the Order as an assistant in this process, while in other more media exposed ones, like for example the Freeport [process], he’s done nothing”, the former inspector added.

Last week, during the audience where closing arguments were presented, the Order’s representative, Rodrigo Santiago, called the involved policemen “criminals” and “cowards”. “He will naturally have to answer for that”, Paulo Cristóvão added, recalling that “this was the first time, out of 13 trial sessions, that I saw Rodrigo Santiago awake for such a long time”.

Paulo Cristóvão, who currently heads a consultancy firm, told ‘Público’ that he left the PJ “because he can’t bear the shame of having stood in a line-up” (it was intended for Leonor Cipriano to point him out as one of her assaulters, which never happened). “I ended up being supported by all of my colleagues, but I never had institutional support. The shame and the humiliation helped me to decide to leave the PJ”, he said.

The former policeman is convinced that he will be acquitted of the accusations (of having created conditions for a third party, unknown, to torture Joana’s mother), just like the other four arguidos. “I was never pointed out or recognised in any one of the accusations, nor was any one of my former colleagues, therefore I don’t see any motive to doubt an acquittal”, says Paulo Cristóvão, who is nevertheless equally convinced that Leonor Cipriano was aggressed during the time that the investigations were ongoing.

“During the first two weeks that she spent at the Prison in Odemira, Leonor Cipriano was together with other inmates and some of them beat her up on several occasions. It was only later, when she was isolated and the prison director [Ana Calado] started to visit her in her cell, that she started saying that she would receive a hefty compensation from the PJ”, the former policeman says.

“The prison director is one of the persons in this process who have major responsibilities. Without any legitimacy, she would lock herself in the cell with Leonor, supposedly to make her say where Joana’s cadaver was. She had no right whatsoever to act in this way, as she was compromising the inspectors’ work”, he said.

Paulo Cristóvão further recalls that Leonor’s lesions, as a pathologist said in the Court of Faro, happened on three different dates. “The older ones are about 20 days old, while the most recent ones were inflicted 10 and 12 days before. Therefore, it is curious that we [PJ inspectors] are being accused, because we only arrived at the investigation two days before the lady fell down the stairwell [inside the PJ’s building, during a recess in between questioning sessions]”.

The sentencing in this case, in which the Public Ministry demands the policemen’s conviction, is scheduled for the 22nd of May.

Joana case: Leonor’s lawyer requests a new inquiry and a revision of the girl’s mother’s sentence


Faro, 19 May (Lusa) – Today, Leonor Cipriano’s lawyer in the case of alleged aggressions has requested the opening of a new inquiry into the Joana case and the acquittal of the little girl’s mother, after João Cipriano confessed in writing that he tried to sell her.

Only a few days before the reading of the sentence in the case of alleged aggressions by PJ inspectors, that is scheduled for Friday, Marcos Aragão Correia asks for the opening of a new inquiry and the revision of the sentence that was applied to Leonor, who was sentenced to 16 years in prison.

With the new inquiry, the lawyers wants the alleged buyers of Joana to be identified and also that Leonor is acquitted of the crime of her daughter’s murder, as it is “only” up to João to reveal the destiny that he gave to the little girl.

To the document, which was sent to the Attorney General and to the press today, Aragão Correia annexes a copy of a statement by João Cipriano, in which the latter confesses that he tried to sell the little girl, without further detail.

According to Leonor’s lawyer, the confession – that was written “by the hand” of João Cipriano himself -, corroborates the version of Joana's mother, who in January confessed in writing to having given consent for her brother to sell the child.

In the document, it can be read that the confession from Joana’s uncle – despite not adding any details about the body’s location -, and the one from Leonor constitute “sufficient” elements of proof to open a new inquiry.

Aragão Correia says that João Cipriano only confessed the truth due to the “fear” that he manifested of being killed inside the prison by inmates “hired by the criminals that tried to buy Joana”.

Therefore, the lawyer adds, the confession has the goal to ensure that João is awarded State protection, given the fact that it is the “same fear” that prevents him from identifying the “other criminals” and indicating the location of the cadaver.

The new inquiry would serve the purpose of identifying Joana’s buyers and recovering the body, says Aragão Correia, stressing that given the fact that the transaction was not successful, only João Cipriano can reveal the destiny that he gave to the little girl.

Aragão Correia further stresses that João Cipriano, who serves a 16-year sentence at the Prison of Carregueira, had already served a seven year sentence over attempted murder.

Leonor Ciprianos lawyer confesses to lying to obtain a confession

Lawyer Aragão Correia, who defends Leonor Cipriano, Joanas mother, told TSF this Tuesday that he lied to obtain a written confession from João Cipriano, who revealed that he tried to sell the child.

Aragão Correia had already requested the opening of a new inquiry after Leonor Cipriano confessed to him that she handed over her daughter to her brother, for him to sell her.

Now, the lawyer revealed that he visited João Cipriano in prison and that the latter confessed that he tried to sell the little girl. But in order to force a confession, in writing, Aragão Correia admitted to bluffing.

The lawyer confessed that he told João Cipriano that the persons who wanted to buy Joana gave an order to murder him in prison.

He was very fearful, which confirms that Leonor was telling the truth, he added.

For Aragão Correia, it was João Cipriano who murdered the child although the inmate at Carregueira prison never admitted it.

Now, in a request that was sent to the Attorney General, Aragão Correia requests for the process to be reopened in order to investigate the identity of the persons who tried to buy Joana and for Leonor Cipriano to be acquitted of the crime of homicide.

The case of Joana Ciprianos disappearance, which dates back to 2004, will know further developments this week, at a time when members of the Polícia Judiciária will hear the sentence over the accusation of having used torture methods against Leonor Cipriano.

Joana’s uncle tried to sell her

Leonor Cipriano’s lawyer asked the Attorney General to open a new inquiry, in order to find out what really happened to the little girl from Figueira, and to review the sentence that condemned siblings Leonor and João over the death of Joana. Aragão Correia justifies the request with a confession from João Cipriano, the child’s uncle, “written by his own hand, on Monday, where the inmate reveals that he tried to sell his niece”.

In s statement to 24horas, Marcos Aragão clarifies that “João’s confession was obtained in exchange for requesting State protection, because he fears being murdered, inside the prison where he is, in Carregueira, under orders from the criminals that tried to buy Joana”, a strategy that was used by Aragão that “left João in a panic”.

The lawyer says that “the Public Ministry must discover who wanted to buy Joana and for what purpose, recover the body for forensic and post-mortem testing and give her a decent funeral”.

For António Cabrita, Gonçalo Amaral’s lawyer, neither the alleged confession from João nor the request from Aragão deserve any credibility. “It’s strange that the writing of the alleged confession and the signature are different”, the lawyer said, observing similarities with the writing that had been used already in Leonor’s last confession, which was also made public by Aragão. He also notes that “strangely, Cipriano is sometimes written with a C, sometimes with an S”.

Confession and torture

Concerning the request that was presented to [Attorney General] Pinto Monteiro, António Cabrita says that “Aragão Correia must be confusing searching with prosecutor”. He recalls that any request to reopen the inquiry should be filed, in this case, with the court of Portimão, where the trial took place.

João Cipriano’s alleged confession is made public “on the eve” of the reading of the sentence that will either acquit or condemn the inspectors that stand accused of torturing Leonor Cipriano in order to obtain further information about the location of her daughter’s body.

Cipriano Case: PJ Inspectors Accused at Faro Trial

The collective of judges considered that Leonor Cipriano was tortured, even though it could not be proved by whom. In the verdict read today, two PJ inspectors were accused, António Nunes Cardoso for document forgery and Gonçalo Amaral for simple false testimony, he was acquitted in relation to the crime of omission of denunciation of the aggressions suffered by Leonor Cipriano. The other three arguidos [defendants], Leonel Morgado Marques, Paulo Pereira Cristóvão and Paulo Marques Bom were absolved of the crime of torture.

It wasn't proved who ordered the aggressions to Leonor Cipriano in 2004.

Gonçalo Amaral was sentenced to one year and six months of suspended sentence, and António Nunes Cardoso to two years and six months of suspended sentence also.

Gonçalo Amaral was convicted for simple false statement, since the version of the alleged fall on the stairs of Leonor Cipriano wasn't proved. Thus, the court considered that Amaral had lied, in order to cover the actions of his unknown colleagues.

The court concluded that António Nunes Cardoso falsified a document, which reported the fall on the stairs of Leonor Cipriano. The sentence for Cardoso was aggravated, given his position as a police officer, "of whom is required to fight the crime."

The lawyers for Leonor Cipriano, Marcos Aragão Correia and the assistant representing the Bar Rodrigo Santiago will appeal as well as António Cabrita, Gonçalo Amaral's lawyer.

Leonor confessed the crime on the 13th of October and alleged being beaten a day later

Leonor Cipriano, confessed all of the facts related to her daughter's murder to the PJ on the 13th of October 2004, in the presence of her lawyer, who at the time was Célia Costa. Leonor's brother, João Cipriano, had previously confessed the crimes a few days before, on the 8 of October.

Leonor Cipriano and the brother João were condemned by the Portimão Court to sentences of 20 and 19 years, respectively, for the crimes of qualified homicide and for hiding the cadaver. The appeals to the Supreme ended up reducing the sentences to 16 years each. The Cadaver of Joana, 8 years old, was never found.

Leonor Cipriano appeals Gonçalo Amaral’s sentence

Joana’s mother requests condemnation and effective prison sentence for the four PJ inspectors that were acquitted of the crime of torture in May

Leonor Cipriano, the mother of Joana, the little girl that disappeared from Figueira in 2004, has appealed the sentence of Gonçalo Amaral and three other former PJ inspectors, in the case of aggressions that she allegedly suffered during questioning in Faro.

The appeal, which was filed this Thursday at the Appeals Court of Évora, requests the condemnation and effective prison sentence for the arguidos that were acquitted by the Court of Faro, tvi24.pt was told by Leonor Cipriano’s lawyer, Marcos Aragão Correia.

According to the document that was given to tvi24.pt by Aragão Correia, Leonor Cipriano files an appeal because she disagrees with the sentence that was given on the 22nd of May by the Court of Faro, where inspectors Leonel Marques, Paulo Cristóvão and Paulo Marques Bom were acquitted over the crime of torture.

Joana’s mother also disagrees the acquittal of Gonçalo Amaral over the crime of omission of denunciation, as well as the application of only 1 year and 6 months in prison with a suspended sentence over the crime of false deposition.

Justifying these discrepancies, Leonor Cipriano’s defence mentions that the ruling of Mat 22 “suffers from contradictions”, by acquitting the arguidos. This because “the ruling itself considered proved that a fall from the stairs didn’t exist [as the defence alleged] and that the arguido Gonçalo de Sousa Amaral knew that truth perfectly well”.

Alleged complaint from Gonçalo Amaral’s wife

Leonor Cipriano’s defence further mentions that one of the “extremely important pieces of evidence” against Gonçalo Amaral was refused by the judge three months after the first request. That evidence concerns a complaint that was presented by the wife of arguido Gonçalo Amaral against her own husband.

In the complaint, which was presented on the 23rd of December 2007 in the shape of a letter that was directed at Guilhermino da Encarnação, the PJ’s Joint National Director in Faro, Gonçalo Amaral’s wife asks for help to trace her underage daughter that was living with her father.

In the letter, which Leonor Cipriano’s lawyer sent to tvi24.pt, Alexandra Leal mentions that she found her husband, Gonçalo Amaral, “consuming alcoholic drinks, together with other colleagues”. In another excerpt, the wife of the former coordinator of the PJ’s Criminal Investigation Department of Portimão mentions that Gonçalo Amaral “ordered me to enter the house, where he insulted me and threatened me with death”.

Contacted by tvi24.pt and questioned about whether or not he received said complaint at the time, Guilhermino Encarnação declined to comment.

To tvi24.pt, Aragão Correia, Leonor Cipriano’s lawyer, mentions that the letter, to which he had access through a source at the PJ’s Faro Directory, was only “mentioned for the first time five months ago”. At that time, according to Aragão Correia, both Gonçalo Amaral and his wife, Alexandra Leal, “denied that any complaint had been presented” and “stated that the letter was not authentic”.

Joana’s mother’s lawyer stresses that the letter from Gonçalo Amaral’s wife, and another document from the PJ’s picket that proves that the complaint entered the police, is of “extreme importance”. This because it “proves the violent, criminal and inhuman personality of arguido Gonçalo Amaral”, the lawyer states.

Leonor Cipriano’s defence disagrees that those two documents were “completely ignored” by the Court and now requests for them to be known by the Appeals Court in Évora.

Leonor Cipriano and her brother, João Cipriano, were condemned by the Supreme Court of Justice to 16 years in prison over the crimes of homicide and concealment of a cadaver.

Leonor Cipriano’s son Carries a Gun

“Terrible, uncontrollable, with episodes of physical and verbal violence”. This is how A., aged ten, son of Leonor Cipriano – who was condemned in 2005 to 16 years in prison over the murder of her daughter Joana -, is described in the neighbourhood where he resides in Porches, and where last week he took a lead gun to school, which was apprehended by the GNR.

Neighbours told CM that it is frequent for them to be insulted by the child “who respects nobody, not even his father or his stepmother”. The situation was the last drop in a process that has been dragging on for years, when the child first went to school.

Yesterday afternoon, the school’s parents association took the case to the Public Ministry of Portimão. “This was an SOS, a call for help. A. has been signalled by the Child Protection Commission and his situation has also been followed by the school, the town hall and the Regional Education Directory. He was the target of a specific educational project, with no results”, the vice president of the parents’ association, Maria do Carmo, clarified. The latter defends the need for A. to be institutionalised, a measure that is apparently supported by the child’s father himself. “Someone has to help A. to avoid him being a criminal, which he is already”, Maria do Carmo laments.

Leonor Cipriano’s lawyer requests revision of sentence and wants acquittal

Today, Leonor Cipriano’s lawyer has presented the Supreme Court of Justice (SCJ) with an extraordinary appeal for the revision of the sentence that Joana’s mother was condemned to, due to his consideration that new facts have been discovered

The request for a revision of the sentence appears after it was proved in court that Leonor was aggressed in the building of the Polícia Judiciária (PJ) in Faro, although it was not proved who aggressed her or in what manner.

In a press release, Marcos Aragão Correia says that the girl’s mother – who was condemned to 16 years in prison over the co-authorship of Joana’s murder – must be “acquitted” because there are new facts and evidence that raise “very serious doubts” about the condemnation’s justice.

As a first “turnaround” in the process, the lawyer points towards Leonor Cipriano’s confession, which was made in January, in which she denies being involved in her daughter’s death and points to her brother, João Cipriano, as being responsible for her death, after a failed attempt to sell the little girl.

At the time of the confession, five PJ inspectors and former inspectors stood trial in Faro, involved in a process of alleged aggressions on Leonor during questioning, a trial during which she gave false testimony, which has already prompted the opening of an inquiry.

The Court of Faro ended up acquitting the three inspectors that stood accused of torture, but condemned two (Gonçalo Amaral and António Cardoso), who were accused of other crimes, to suspended prison sentences.

According to Aragão Correia, Leonor’s condemnation was based on “false confessions” that were obtained under “brutal” torture, but also on the false accusations that were proffered against her by the brother who until a short while ago incriminated her as a co-author of the crime.

In order to try to reverse the situation, the lawyer says he bluffed João Cipriano in order to convince him to sign a confession, that was written down at the Prison of Carregueira, Sintra, in May, in which he stated that he tried to sell the little girl.

Aragão Correia told Leonor’s brother that he had heard that a convict that had been condemned to over 20 years for murder was going to be transferred to the Prison of Carregueira with the purpose of murdering him.

The order to kill João would have come from elements of a criminal network that tried to buy Joana, stresses Aragão Correia, who assumes that he invented the story in order to force Leonor’s brother to confess that he had lied throughout the entire process.

“João Cipriano has no juridical gain from this confession, quite to the contrary”, the lawyer stresses, adding that, apart from homicide, the convict will now have to answer over the crime of human trafficking.

According to Aragão Correia, Leonor Cipriano’s condemnation was already “very frail” and “doubtful” from a factual and juridical point of view, gaps that are stressed by the new evidence and facts.

“We can only conclude that the court merely based itself – unconsciously – on the false indications of the inquiry, namely on the false confession from Leonor (which was obtained under torture) and above all on the systematic lies of João Cipriano”, the lawyer underlines.

The process of alleged aggressions against Leonor Cipriano is linked to the ‘Joana case’ that dates back to the 12th of September 2004, the day when the child, aged eight, disappeared from the village of Figueira, Portimão.

Following the questioning that took place at the PJ in Faro, Joana’s mother allegedly presented lesions to her face and body, which prompted the accusations from the Public Ministry against former and present PJ inspectors, three of whom were indicted over torture to obtain a confession.

Leonor Cipriano and her brother, João Cipriano, were condemned by the Supreme Court of Justice to 16 years in prison each, over the crimes of homicide and concealment of Joana’s cadaver.

Leonor Cipriano tries to annul condemnation

Leonor Cipriano’s lawyer asserts that he “discovered new facts and evidence” that he believes are enough to annul the condemnation of Joana’s mother over homicide and concealment of a cadaver. This is what he requested in the revision appeal that he filed with the Court of Portimão yesterday.

The new “evidence” are statements from relatives and acquaintances of Leonor, who attest that she was a “good mother”, “incapable of hurting her daughter” and that she “never beat her”. Aragão Correia further mentions two alleged confessions by Leonor and João, in which both report an attempt to sell the child to a foreign couple.

Another argument is the decision by the Court of Faro in the process that accused five PJ investigators in the “Joana case”. On the 22nd of May, it was accepted as proved that the woman was aggressed at the PJ in Faro in order to confess where she had concealed the child’s body. Nevertheless, the lawyer insists that Leonor was aggressed in order to confess the homicide. The appeal will be forwarded to the Supreme Court of Justice.
