Kayleah Wilson's mom thanks community‎

GREELEY - The mother of Kayleah Wilson, April Wilson, offered words of appreciation Tuesday to the community who helped look for her daughter.

"I just want to say thank you to everybody that's helped, even before this with the searches and the volunteers opening up their doors for us ... and after the horrible news," Wilson said.

She spoke at a fundraiser at Culver's restaurant in Greeley. Culver's raised money for the Wilson family over the weekend. The restaurant gave all profits made on Sunday and Monday to the Kayleah Wilson Memorial Fund. The Greeley Gazette and Pirate radio 104.7 helped organize the event.

Former spokeswoman of missing girl's family stole about $2,000

The woman who helped organize community searches for a missing Greeley girl in the past few months will spend the next two years under probation for theft from the parent organization she ran for Cameron Elementary School last year.

Weld District Court Judge Gilbert Gutierrez sentenced Michelle Thompson, 38, to a two-year deferred sentence on Friday, though he said he wasn't terribly comfortable with the plea deal attorneys worked out in the case, given she had a theft conviction in 1996.

The former boyfriend of a 12-year-old girl found slain in Greeley last May will remain in jail under a $100,000 bond.

Ex-boyfriend of missing girl to stand trial

GREELEY, COLO. — An 18-year-old accused of having a sexual relationship with a missing Greeley girl who was found dead has been ordered to stand trial.

A Weld County district judge on Thursday scheduled a four-day jury trial for Roberto Laurencio Montoya starting Nov. 15.

He's accused of having sex with 12-year-old Kayleah (kay-LEE'-uh) Wilson.

Defense lawyers told the judge Montoya and Wilson had sex once before Montoya turned 18. Prosecutors say their relationship continued after Montoya turned 18.

Kayleah Wilson was missing for two months before her boy was found in a ditch in Greeley on May 19. Her friends said she had talked about possibly being pregnant but investigators say an autopsy didn't indicate that she had been pregnant.

The mother of a slain 12-year-old Greeley girl talked again Thursday about the first time she learned her daughter was having sex with an 18-year-old who was living in the same apartment.

April Wilson testified in a pretrial motions hearing for Robert Montoya in Weld County District Court. Montoya is not charged in Kayleah Wilson's death but faces charges of sexual assault on a child and sexual assault on a child with a pattern of abuse.

April Wilson related how she first found out about possible sexual relations between her daughter and Montoya when she read a posting on the family computer. She said she immediately confronted the two of them in a family meeting that occurred between Christmas and New Year's in 2009. She said Montoya had been living with the family for more than a couple of months at that time

Police had frequent contact with Montoya after Kayleah disappearance‎

In the weeks following the disappearance of Kayleah Wilson, police were in daily, sometimes twice-daily, contact with Robert Montoya.

Montoya, now 19, made his second appearance Friday in Weld District Court for a pre-trial motions hearings, where attorneys have presented evidence to be considered at trial.

Montoya is charged with sexually assaulting 12-year-old Kayleah from October 2009, when he was 17, to March 2010, during which time he'd turned 18. Though evidence from her mother and brother suggest they knew of only one sexual encounter in the fall, prosecutors believe there were much more. Montoya told police of several sexual encounters, which admissions defense attorneys hope Weld District Court Judge Marcelo Kopcow will throw out.

Prosecutors didn't get through all of their witnesses Friday, and they have continued the matter for a second time to later this month, at which time they should argue their cases.

Defense: Kayleah family holding boyfriend accountable for death

A defense attorney for the man accused of sexually assaulting Kayleah Wilson before she disappeared last spring said the Wilson family is using the sexual assault case to hold him responsible for the girl’s death.

In a third day of hearings on pre-trial motions, attorneys on Tuesday argued what evidence should be admitted in the upcoming trial of Robert Montoya, who is charged with two counts of sexual assault against Kayleah Wilson. One charge involves a pattern of abuse.

It’s a case in which prosecutors are relying heavily on a grieving family’s recollections of incidents involving Montoya and Kayleah, which have been somewhat inconsistent as the case has worn on. The family has struggled with remembering time periods of specific instances involving Montoya, who had lived at the Wilson home for a few months in 2009. April Wilson learned of the sexual contact between the then 17-year-old Montoya and her daughter, and threw him out of the house.

“They had every motive then to cast blame, as they do now, as witnesses in this trial to be casting blame to Mr. Montoya,” defense attorney Kevin Strobel said Tuesday before Judge Marcelo Kopcow. “They’re not reliable historians, and they certainly have motive and bias to testify against him.”

April Wilson did not attend the hearing, and she could not be reached for comment.

The 12-year-old girl’s body was found May 19 in a drainage ditch in southwest Greeley.

Sexual-assault trial starts today in Kayleah Wilson case‎

A key figure in the puzzle surrounding the disappearance and death of 12-year-old Kayleah Wilson faces trial today in Weld County District Court.

Robert Laurencio Montoya, 19, will be fighting allegations he sexually assaulted Wilson before she vanished last March 28 while on her way to a birthday party near the Greeley Mall.

Kayleah's body was found May 19 in a Greeley irrigation ditch after a two- month search by police and the FBI. Police say she was killed and her body dumped in the water.

Montoya is not a suspect, but he is still considered a person of interest in Kayleah's murder, said Greeley police spokesman Joe Tymkowych.
