Attempt to lynch the brother of Santiago del Valle, the man accused of the murder of Mari Luz Cortés

"Around 100 people tried to break into the brother's home in Huelva, as the parents launch a petition to keep child killers in prison for life.
More than 100 people in the El Torrejón district of Huelva have tried to lynch the brother of Santiago del Valle, the man accused of killing the five year old local girl Mari Luz Cortés. The group tried to get into the brother’s home and threw stones at the building, shouting that he had helped to cover up the crime.

Francisco del Valle has however told the press that he is prepared to testify against his brother Santiago, while his wife has said they can no longer live in the area and have to move as both she and their 17 year old daughter had come under threat. National and anti-riot Police had to intervene late on Monday night to stop the aggression from progressing. The Government Sub Delegate for Huelva, Manuel Bago, commented that the brother did not deserve what was happening.

Mari Luz’s father was among the protestors and commented that it was Francisco who brought his brother to the district and that initially he defended him.

It’s not the first time that the locals have attacked the brother of the suspect. An earlier attack at the end of last month was caught on television.

Meanwhile the parents of Mari Luz Cortés have launched a campaign and petition calling for life imprisonment for those paedophiles who are committed of murder. They say they want to reach 500,000 signatures before presenting the petition to Congress where with that number a debate will have to be held on the reform of the Penal Code. The campaign has reached 20,000 signatures in its first week."

El Pais

8th May 2008

“ (…) I found a sewer. I opened it. It was round and had stairs. I dumped the girl in there. She did not move at any time, neither on our way there nor when I dumped her. But I don’t know if she was dead or alive. I don’t know if she may have drowned. When I dumped her I heard a thump and I closed the lid. I didn’t hear any shouts, nothing. I don’t know if there was water inside the sewer. I could signal the place where I dumped her.” The autopsy revealed that the girl died of suffocation, when the air flow into the lungs was cut, and that she didn’t have any deadly blows. (…)

Mari Luz Cortes .- says the shift of Rafael Tirado litigation "is not synonymous with justice"

Juan José Cortés, the father of the little Mari Luz, Huelva girl who died allegedly at the hands of Santiago del Valle, said today that the transfer of criminal jurisdiction to the Administrative Dispute Seville judge Rafael Tirado, punishable by a fine of 1,500 euros for gross misconduct by failing to execute a statement slope of abuse against the Valley, "is not synonymous with justice."

HUELVA, 25 (EUROPA PRESS)

This was explained to Europa Press by Juan Jose Cortes, who said he has done Tirado is "a personal decision and a comfortable retirement by the pressure that may be subject" to which he added that "this move is not justice. "

In this sense, the father of the little girl insisted that the judge Seville "must assume responsibility because he has committed a very serious fault", just as he recalled that "justice was not done because Tirado has made a personal decision .

The General Council of Judicial Power (CGPJ), as Cortes said, "should sanction a very serious fault and not to change his trial for neglect of responsibility committed in its day." Juan Jose Cortes concluded that justice must be equal for all, both for judges and for citizens. "

Sources said the judge CGPJ Tirado has obtained a place in the Court of Administrative Litigation of Seville - specifically in the number 3 - after participating in the contest his transfer request and be served by the CGPJ.

The National Court cut the suspension to six months for the secretary of the case Mari Luz

Juana Gálvez recourse to have it set aside the penalty completely. Mari Luz's father has described as "unprecedented" decision of the Audiencia Nacional

The National Court has reduced to six months two-year ban suspension imposed by the Ministry of Justice to the Clerk of Court No. 1 Sevilla charge of the case of the girl Mari Luz, Juana Gálvez, sources have indicated National College clerks.

This decision follows the hearing of the appeal that Galvez filed against the penalty imposed by the Ministry of Justice for its action to not execute the imprisonment of Santiago del Valle, Alleged murderer of the girl Mari Luz Cortes, to serve a sentence of 21 months in prison for sexually abusing his own daughter.

Justice blamed the Secretary of "negligence and undue delay in fulfilling the functions of giving of accounts (to inform the judge), promotion and management of the process and their powers of organization, administration, inspection and technical-procedural officials.

The dossier was parallel to the secretary opened by the Supreme Judicial Council (CGPJ) against the criminal court 1, Rafael Tirado, who was fined 1,500 euros by delays in ordering the execution of that sentence.

Last October Juana Gálvez read a statement in which he stated "be quiet" having worked "with absolute dedication and commitment".

Recourse to the total cancellation

Juana Gálvez has said it will appeal to have it set aside completely the measure. The lawyer defending your case has 15 days to appeal before the Board of Litigation of the National Court.

Galvez did not want to make judgments only after obtaining the full sentence of the court of contentious of the National Court, but has advanced that its action was supported by the same arguments that exposed his lawyer at trial, based on workload, delay in supply officials and casualties disproportionate to the 1,500 euros that was sanctioned by the judge.

The secretary thanked the support received from their colleagues throughout Seville and Spain in recent months and especially today, when her phone, has said he has not stopped ringing since mid-morning that transcended the decision of the Audiencia Nacional .

For his part, counsel for the secretary, Ramon Trains, said that lowering the penalty from two years' suspension without pay for six months reflected that "it is beginning to do justice" to Galvez, but clarified than the full relief will not occur until the penalty is completely annulled.

Mari Luz's father considers it "outrageous"

Juan José Cortés, the father of Mari Luz, has described as "unprecedented" decision of the High Court to six months to lower the sanction of two years suspension without pay imposed by the Ministry of Justice Juana Galvez.

Cortes said that "not fair" that the National Court lowered the penalty when the body that owns this worker had spoken.

In his view, is something "unacceptable" and that is unacceptable, while "exacerbates public distrust in justice."

Juana Gálvez was the Clerk of Court No. 1 Criminal Court of Seville, whose owner, Rafael Tirado, imposed the Supreme Judicial Council fined 1,500 euros for delays in ordering the execution of the sentence which convicted for abusing their daughter, the alleged perpetrator of the death of Mari Luz Cortés, Santiago del Valle.

Lowered the penalty to the secretary of "case Mari Luz"

- Juan Jose Cortes shown "outraged" and ensures that no one in government will "pay" for the murder of his daughter

The Central Administrative Litigation Court No. 3 of the National Court reduced from two years to six months suspension without pay with the Ministry of Justice sanctioned the secretary of the Criminal Court 1, Sevilla, Juana Gálvez, by irregularities that led to Santiago del Valle, the murderer of Mari Luz Cortes, were free to non-execution of sentence of imprisonment for abusing his own daughter. .

The ruling concludes that the punishment meted out to Galvez in October for a "serious lack of negligence and undue delay in carrying out his duties" was excessive because "the aggravating factor was grossly overvalued in relation to mitigating circumstances."

The statement stresses that "pronouncements of the various social media" created "an environment that could be prepared for the possibility of imposing an exemplary punishment."

In such circumstances, said the ruling, the Administration did not took into account "expressly" as a mitigating "the increased workload imposed on the court" or the inspection reports of the Judiciary, that "without excusing the defective activity" the secretary, stated "the structural and judged defective.

Mari Luz's father, Juan Jose Cortes, was outraged by the reduction of the penalty, and said the ruling shows that nobody in the administration will "pay" for the murder of his daughter.

Santiago del Valle will be tried for murder of Mari Luz Cortés

According to information published by the daily Huelva, Huelva, the holder of the court, Maria Jose Fernandez Maqueda, also accused the pederast's sister, Rosa del Valle, of the crime of murder, while his wife, Isabel Garcia, was charged with a crime of concealment which until now was the only one released from this case.

Dictate the indictment was to be performed by tamita magistrate No. 1 Huelva after the investigation was terminated a month and a half ago.

The paper also reveals details about the Huelva autopsy, commissioned by the family of Professor Luis Frontela-but then resigned, which was admitted as evidence by the Audiencia Provincial de Huelva and reached conflicting conclusions with the Institute of Legal Medicine (IML) Huelva on the circumstances and time of death of the girl who was less than five years old.

While the IML detected lesions only in the lower right wrist, Frontela found two and concluded that she was fastened or tied when she was alive and had resisted. The professor also detected two blows to the head, regardless of the injury found by the IML beneath the parietal, and an injury to one thigh of the girl to attempt separation, according Huelva Información.

On the circumstances of death, the IML concluded that she could have died from possibly drowning off the coast of the marshes, while Frontela claimed that the girl was already dead when she was deposited in water.

When he lifted a gag order that has hung over the case, it was learned that DNA tests carried out on hair and tissue found in some of the belongings of the accused in the Santiago Del Valle case - they did not involve his sister and wife directly in the events.

The grandfather of Mari Luz Cortés awaiting trial "exemplary"

It is "satisfied" by the allegation of murder to Santiago and Rosa del Valle

Juan Cortes, paternal grandfather of Mari Luz Cortes, yesterday expressed satisfaction with the decision of the Magistrate's Court 1 of Huelva, who will judge Santiago del Valle, which it accuses of murder and sexual assault the girl and his sister Rosa Valley, charged for murder, and his wife, Isabel Garcia, who is believed to have helped with concealing the body. Cortes was confident that the trial would be "exemplary". Speaking to EFE TV, wanted to make clear that "no expert has said that sexual abuse took place," but added that it is "clear that the predator took the child with any intention."

Mari Luz drowned in the Huelva estuary and not by the aggressions of Del Valle

Huelva. (EUROPA PRESS) .- An indictment in the case of the death of Mari Luz Cortés, the little girl who died allegedly at the hands of Santiago del Valle, Says he "tried abuse of minor, Which resisted del Valle proceeding to her by the chest and hitting her, causing injuries that left her unconscious, but without causing death," which, according to the statement, was "by drowning".

Thus, in the indictment, the owner of Court No. 1 of Huelva, Maria Jose Fernandez Maqueda, states that between 16:30 and at 16:40 hours on Sunday afternoon January 13, Mari Luz Cortes left her home to buy sweets at a kiosk near to and behind her home, the defendant was leaning out of a window and "with intent to sexually abuse the child caught her attention by swinging a doll" that she collected to repay.

Thereafter, he delivered several blows that left her unconscious, del Valle came into his house and grabbed a shopping cart, "covering it inside with a jacket" and he asked his sister Rosa to "bring your vehicle round and get rid of it," and she accepted the request.

Both went to the corner of the Marshes area next to Estero, where del Valle, "lowered the body into the water and left it partially submerged in the prone position. Similarly, as the autopsy confirms that the death of the child was due to "asphyxiation by submersion "and that the deceased" was not subject to sexual assault which left any evidence in a thorough examination of the corpse. "

The Police also discredit Santiago del Valle's version of events that the small girl fell into a sewer, because of "the impossibility of manual opening without proper tools" and that samples collected on the underside of Rosa's vehicle, in which Mari Luz was allegedly transported to the place of her death, came from a type of material similar to that found in the boots and the skirt of the child.

For all these reasons, the order accuses that Rosa and Santiago del Valle of the crime of murder, the latter also for sexual assault, and his wife Isabel Garcia of the offense of concealment.

They use the car
For his part, counsel for Santiago del Valle, Juan López Rueda, said yesterday he will appeal the indictment that his client is guilty of murder along with his sister Rosa del Valle, while the latter's attorney, Manuel Dominguez, has already done so.

Rueda Lopez explained that this process will take place tomorrow and that "the grounds for appeal under consideration. For his part, Dominguez said, and has argued against the grounds that order, which in turn accuses Rosa da Valle for the crime of murder, because in his view, the letter implies the existence of a conversation and an agreement between Santiago and Rosa and there is no evidence of this in action.

The order ratifyied the status of detention without bail for Santiago and Rosa del Valle, while maintaining the personal situation of Isabel García Rodríguez, without prejudice to what could be agreed during the pendency of this case.

Mari Luz Cortes died by drowning

Santiago del Valle and his sister Rosa both face murder charges

It has been established that the Huelva five year old, Mari Luz Cortes, died from drowning and was still alive when thrown into the river by the man accused of her abuse and murder, Santiago del Valle García.

The case summary recognises that the child died from drowning and charges Santiago del Valle and his sister with murder. The document also notes that Mari Luz was not the object of any sexual aggression which could leave any evidence, but does note that abuse was attempted and that the child resisted.

Counsel of Santiago del Valle appeals indictment and calls for freedom dismissed

Counsel of Santiago del Valle, Juan López Rueda, appealed today the indictment of the case of the death of Mari Luz Cortés, the small gilr of Huelva who died allegedly at the hands of del Valle, who accuse him of the crime of murder and sexual abuse and requested a dismassal. As explained to the lawyer, Del Valle sent him two letters (11 and 24 June) where he says that "he is innocent and did not even see the girl that day," and requested that, in the belief that no crime or irresponsibility of the accused, there should be an end to the proceedings against him and acquittal.

Moreover, Lopez said Rueda, Rosa del Valle's lawyer, Manuel Domínguez, "could have filed an appeal and now it is unknown whether there will be jury".

As in this case, his sister Rosa del Valle, through her attorney, has used this text as she also is accused of murder and it blames the wife of Santiago del Valle, Isabel Garcia, of the crime of concealment.

The lawyer for Rosa del Valle, Manuel Dominguez, a few days ago said that the letter implies the existence of a conversation and an agreement between Santiago and Rosa and there is no evidence of this in action, which is why it is appealed.

The order suggests that Santiago's attempt to abuse the child, which she resisted, del Valle proceeded to hit her on the chest and in so doing, caused injuries that left her unconscious, but without causing death, "which, according to the letter, was "by drowning".

Thus, in the indictment, the owner of Court No. 1 of Huelva, Maria Jose Fernandez Maqueda, shows that between 16.30 and 16.40 hours on the afternoon of Sunday 13 January, Mari Luz Cortes went his home to buy sweets at a kiosk near to and behind her home , the defendant was leaning out a window and "with intent to sexually abuse the child caught her attention by swinging a doll" that she collected to repay.

Thereafter, and "after delivered several blows that left her unconscious, del Valle came into his house and grabbed a shopping cart by entering the retail and tapándola inside a jacket" and he asked his sister Rosa to "move to lower your vehicle and get rid of it, which accepted the request.

Both went to the marshes area near the corner of Estero, where the Valley, "introduced the lowest in the water and leaving it partially submerged in the prone position. Similarly, as includes the car, the autopsy confirmed that death of the child was due to "drowning" and that the deceased "was not sexually assaulted able to leave evidence in the comprehensive review the corpse. "

The car shows in turn that discredits the Police version of Santiago del Valle that the small shot for a sewer, because of "the impossibility of manual opening without proper tools" and that samples collected on the underside of vehicle Rosa, Mari Luz allegedly transported to the place of his death came from a type of material similar to that found in the boots and the skirt of the child.

For all these reasons, the order alleges that Rosa and Santiago del Valle for the crime of murder, the latter also against sexual freedom, and his wife Isabel Garcia for the crime of concealment.

Official reception to Juan José Cortés, the father of Mari Luz, who chatted with neighbors in Alhaurin de la Torre, Malaga

During the talk, he reviewed his experience with an emotional burden of hope and was fond of authorities and associations. In the afternoon he met with members of the Roma community and the Evangelical Church.

Juan José Cortés, evangelical pastor of the Church of Philadelphia and the father of Mari Luz Cortés, the girl killed in Huelva, visited our town in recent days to talk about their experiences and feelings and convey a message of hope to members of the Roma settled in Alhaurin de la Torre.

The municipal authorities, with the mayor, Joaquín Villanova the lead, accompanied by various social and cultural groups of our people, and with Mariano Maldonado, also known as polio, a member of the members of the Evangelical Church of Philadelphia in Alhaurín de la Torre, were commissioned to carry out his official reception at the Plenary Hall of the City Council, where he delivered a tower identifiable.

Cortes answered questions put to them by members of associations, most of whom he conveyed his sympathy and support.
Upon receipt, Juan José Cortés spoke a few touching words on the football field of the shantytown Viñagrande, members of the religious organization to which it belongs.

The court of 'case Mari Luz', dismantled after the exodus of all staff

The Criminal Court No. 1 of Seville, famous for the error that freed the murderer of Mari Luz Cortés, will be virtually dismantled within days. The abandonment of the titular judge Rafael Tirado, now in a contentious court, and the secretary, Joan Galvez, who will go to a Trade, now joins the massive exodus of more senior officials, who were holders of its terms and bore the brunt of the work.

The last shuttle contest organized by the Ministry of Justice and Public Administration has brought no surprises and three of the four staff member of the Criminal Court 1 have obtained a place in other places, while the fourth is pending an appeal and may join their peers in a short time.

The lists with the results of this contest are still provisional and the signs are that in the final, once claims are settled, will be the transfers of all staff who have requested such, which will leave this court in a complicated situation, with only two staff with some experience, and the rest of the staff - including the judge and the secretary or acting - as newcomers.

Officials have announced this decision two months ago in a complaint forwarded to the Ombudsman, Enrique Mugica, which claimed that "Tables of the four enforcement officials with decisions taken by mountains of folders" situation that workers considered 'uncontrollable'.

As a result, the Ombudsman came to open an investigation, together with the Ministry of Justice and the General Council of the Judiciary (CGPJ) to know the status of court. The Ombudsman's 2008 Annual Report includes staff members of this body held that if the situation was already "delicate", the most recent judicial reforms "have come to saturate" their business, since "executions dealt conviction for crimes of gender violence and new traffic-related crimes with the same number of staff then, and do not have sufficient and appropriate technical means.

The exodus of the officers comes a few months after that, first, Judge Tirado and then secretary, Juana Gálvez, the corresponding request reassignment after being punished, of very unequal manner, by the release of the the lowest murderer.

The judge called in May Tirado transfer the Court of Administrative Litigation 3, vacant since April, when its previous owner, Jose Guillermo del Pino Romero was appointed judge of the Administrative Litigation Division of the Superior Court of Justice of Andalusia (TSJA). For its part, in the decision to Juana Gálvez, culminating six monthsWeighed several reasons. In addition to the derivatives of judicial and political scandal triggered a year ago, Galvez has clear preference for the civil jurisdiction, which has developed most of his career. In fact, his arrival at the Criminal Court 1 was accidental.

The owner of Court No. 1 of Huelva considers ground that Santiago del Valle "tried to bully" the girl Mari Luz Cortes, who was left in an unconscious state after resisting which they threw into the marshes of Huelva, where according to the autopsy died by drowning.

Jordi Gonzalez portrayed the alleged murderer of Mari Luz

On Thursday Telecinco will continue this series with 'The portrait of the beast' (00.00), a report conducted by Jordi Gonzalez on Santiago del Valle (pictured), alleged murderer of the little Mari Luz Cortés.

Presented by Jordi Gonzalez and conducted by the research team Quartz TV, the document shows a detailed portrait of Santiago del Valle and offers a reconstruction of his life thanks to testimony from numerous family and friends.

Mari Luz Cortes, an alleged victim of Santiago del Valle, disappeared on January 13, when she left her house to buy candy in a kiosk in El Torrejón district of Huelva. The parents hope to find her alive was cut short 54 days later when the girl's body was found in the Huelva estuary.

In 1965 Santiago del Valle was born in Huelva, the fourth of nine children - three boys and six girls, to a couple formed by Juan, a man who worked as street vendors, and Rosa, a cleaner in an office. In this interview, Catalina, the seventh daughter of Juan and Rosa, gives first-person accounts that her brother abused her when she was five and thirteen. In addition, Del Valle's old neighbours suspect that the alleged perpetrator of the death of Mari Luz Cortes may have abused his own mother Maria.

"Sexual abuse of children have been in his life and among his victims are his daughter, Nuria," denounces the report, "who was abused when she was five, a nine year old girl in 2003, a minor in Gijon in 2006; another small child at the end of 2006 (the police caught him abusing her in a park), and another child in January 2007. "

This document also has the revealing statements by the laws of Del Valle, showing his utter revulsion toward his daughter Isabel and her husband of some residents of the municipality of Cazalla de la Sierra y del Barrio and the Neighborhood of the 3,000 homes, where Santiago del Valle and his wife resided, and a teacher whom the principal accused in the 'case Mari Luz' [Santiago del Valle] sued in January 1999 for the abuses she inflicted on his daughter Nuria, complaints that later proved false.

Also, 'The portrait of the beast' includes the testimony of Juan José Cortés, the father of the murdered little gilr from Huelva, who has launched a campaign seeking the imposition of life imprisonment for murderers and pedophiles creating a public register pedophile nationally and internationally.

The alleged murderer of Mari Luz Cortes has been diagnosed with paranoid schizophrenia. Javier Criado, psychiatrist and expert of mental disorder, said in the interview that when Del Valle crimes committed against him "do what they want, what you want to do. He knows what he does and the social penalty involved and Even so, it does. "

Currently, Santiago del Valle, remains in the Granada Albolote prison, the centre also holds his sister Rosa, also charged for the alleged murder of Mari Luz Cortés.

Father of Mari Luz Cortés considering entering local politics

He is discussing with the centre UPyD party standing as their candidate for Mayor of Huelva

Juan José Cortés, the father of the five year old from Huelva, Mari Luz, who was found killed in March last year, could be entering politics as a candidate for Mayor of Huelva, it’s been revealed.

He is understood to have been discussing the possibility with the UPyD party, the Union, Progress and Democracy centre party formed two years ago and led by one of its founders, Rosa Díez.

Público reports the proposal from UPyD is to be made to Juan José Cortés this Wednesday, asking him to stand as the party’s candidate for Mayor of Huelva in the 2011 municipal election. Cortés says he will only decide after discussing it with his family and, if he does accept, will ‘work for the people’. He has previously expressed an interest in entering politics, but describes it as a decision which must not be taken lightly.

Juan José Cortés began a personal crusade across the country to demand harsher sentences for paedophiles following the arrest of a known paedophile, Santiago del Valle, for his daughter’s death. Del Valle should have been in prison when Mari Luz was killed, but was kept free by a judicial error despite two firm sentences against him for child abuse, including his own five year old daughter.

The tour for collecting signatures, which will be in Murcia until 21.00 pm today, traces the Spanish geography in order to collect three or four million signatures that the girl's father, Juan José Cortés, considered necessary to bring the Congress of Deputies his proposal to toughen penalties against child molesters.

HUELVA, 30 Sep.

The Court dismissed the counsel of Rosa del Valle and keeps her prosecution for murder

Huelva Provincial Court has dismissed an appeal against the indictment issued by the Court No. 1, submitted by Manuel Dominguez, counsel for Rosa del Valle, sister of the alleged murderer of the little Mari Luz Cortés, thus keeping prosecution for murder.

Dominguez, who said on 11 September before the hearing that there was "no evidence" to prosecute his client of murder and requested a modification to "have a charge of crime that is more in line with law," he told Europa Press that the court "I denied everything."

In this regard, said the resolution "at no time refers to the existence of a conversation between Rosa and her brother Santiago del Valle," but emphasized that "does make mention of the hairs found in the car and the clothes girl and the soil attached to the underside of Rosa del Valle's car, which are similar to those in the area where he allegedly tossed the child. "

However, as said Dominguez, the latter two are "scientific evidence they need to be compared" as said "not necessarily mean that a person has committed a murder."

In this regard, he noted that "Rosa del Valle is being prosecuted for murder on the existence of a conversation in which Santiago tells this fact and accepts help, but this conversation does not exist", while insisted that the resolution "makes no mention of this conversation."

SET FOR OCTOBER 9

On the other hand, the view in the First Section of the Audiencia Provincial de Huelva of appeals by lawyers for Santiago del Valle and Isabel Garcia - charged with murder and concealment, respectively, of the death of Mari Luz Cortés - against the indictment issued by the Court No. 1 on last June, will be held on October 9.

The lawyer for Del Valle, Juan López Rueda, said the appeal against the indictment was made because the alleged predator said she was "innocent" and denies the facts that the holder of the magistrate No. 1, Maria Jose Fernandez Maqueda , alleged in that order.
