Baby Gabriel's mom quiet about his whereabouts

.... Johnson and Smith have hearings in Maricopa County Superior Court this month. A hearing on the finding that Johnson is competent to stand trial is scheduled for Sept. 23 and 27.

A status conference for Smith, who has been out of jail since March on a $15,000 bond, is scheduled for Sept. 27.

Possible plea deal in Baby Gabriel case fuels uproar‎

News that Tammi Peters Smith, one of the women at the heart of the Baby Gabriel case, is discussing a plea bargain has triggered a new Facebook page, sent a ripple of posts on some of the 20 others and angered some Gilbert and San Antonio mothers who are against any deal.

It has also prompted Smith, 38, of Scottsdale, to say she will be exonerated.

"The public doesn't know the truth," said Smith, referring in part to many pages of evidence people haven't seen. "Once the truth comes out I will be proved innocent."

Smith is charged with custodial interference and forgery and has a Sept. 27 status conference scheduled in Maricopa County Superior Court.

Judge delays trial date in missing Ariz. baby case

A Phoenix judge on Monday delayed setting the trial date for the mother of an Arizona baby missing since December and the boy's would-be adoptive mother.

Maricopa County Superior Court Judge Paul McMurdie said he'll decide the trial date during a hearing Oct. 25.

Elizabeth Johnson, 24, the boy's mother, has pleaded not guilty to charges of kidnapping, child abuse and custodial interference in the disappearance of her son Gabriel, who was 8 months old when he was last seen in December in San Antonio.

Police don't know whether the boy is alive.

Johnson attended the hearing in her black-and-white jail uniform, chatting with a nearby inmate and her attorneys. She did not speak during the hearing.

Baby Gabriel's mom is open to plea deal‎

The judge in the criminal case against Baby Gabriel's mother, Elizabeth Johnson, and the woman who wanted to adopt him, Tammi Smith, Monday postponed a hearing on the much-watched case.

Meanwhile, Johnson's attorney, Nick Alcock of the Phoenix law firm Alcock and Associates, said outside court that a plea bargain is not out of the question.

"If a favorable plea offer is extended we will consider it," said Alcock, whose client was ruled competent to stand trial last week.

Smith waived her appearance at the Monday status conference in Maricopa County Superior Court, at which Judge Paul McMurdie postponed setting a trial date until Oct. 25, over the state's objection.

Woman in missing baby case can no longer afford her lawyers‎

The lawyers who represented a woman in the case of missing baby Gabriel Johnson since February no longer will be representing her in future court proceedings because they stated in court documents that she no longer can afford to pay them.

Michael Kimerer and Amy Nguyen, who had been representing Tammi Peters Smith since February in the case of the missing boy last seen Dec. 26, filed a notice of withdraw with Maricopa County Superior Court Judge Paul McMurdie on Monday to inform him they no longer would be representing Smith. The lawyers also requested that the court appoint an attorney for her.

Smith, 38, of Scottsdale, has been charged with forgery, custodial interference and conspiracy to commit custodial interference in connection with the case of the missing baby, who last was seen on Dec. 26 with his mother, Elizabeth Johnson at a motel in San Antonio, Texas.

Tammi Smith, 38, charged in the case of missing Baby Gabriel, will receive a court-appointed attorney.

Monday, Maricopa County Superior Court Judge Paul McMurdie allowed Smith's previous lawyer, Amy Nguyen, who recently left the office of Kimerer and Derrick of Phoenix, to withdraw from the case.

Baby Gabriel case tainted by detective, mom's lawyers say‎

Defense attorneys plan to file a motion Friday to dismiss charges against Elizabeth Johnson, the Tempe mother charged with kidnapping in the disappearance of her infant son.

Their motion alleges that a police detective from San Antonio, where 8-month-old Baby Gabriel was last seen alive, talked his way into an unauthorized jailhouse interview with Johnson in May.

According to the motion, the Maricopa County Attorney's Office had already turned down the detective's request for an interview, but he managed to gain access to Johnson. He spoke to her for at least three hours outside the presence of her attorneys and tape-recorded statements that he refused to disclose, some of which may have been incriminating.

Attorneys for missing baby's mom: Detective tainted case‎

Attorneys representing the Tempe mother of missing baby Gabriel Johnson say they are moving forward with a motion to dismiss a case against her, claiming her constitutional rights were violated when a San Antonio police detective interviewed her in May in a Maricopa County jail.

Nicholas Alcock, one of two attorneys representing Elizabeth Johnson, said he and attorney Adam Feldman plan to file the motion with Maricopa County Superior Court Judge Paul McMurdie Friday afternoon, claiming her rights were violated when the detective interviewed her at length without legal counsel present.

The attorneys claim their relationship with Johnson has been damaged beyond repair because of the interview and they no longer could ethically represent her.

“This is outrageous,” Alcock told the Tribune on Friday. “This was an exhausting interview, and by the end of it, she was clearly disturbed."

CBS 5 News has learned that attorneys for the mother of an Arizona baby missing since December are filing a motion to have the case against her dismissed.

According to court papers, Elizabeth Johnson's attorneys claim her right to an attorney was violated by an unauthorized interview in May.

Johnson's attorneys were filing the motion electronically.

She's charged with kidnapping and child abuse involving Gabriel Johnson, who was 8 months old when he was last seen. The case has become known as the Baby Gabriel case.

Police said they don't know where the boy is or whether he's alive.

Attorney: Baby Gabriel's mom's rights violated‎

Attorneys for Elizabeth Johnson say a San Antonio police detective has tainted the case against her.

The attorneys claim the detective violated her constitutional rights by interviewing her at length without a lawyer present during a May interview, according to the East Valley Tribune.

They plan to file a motion with the court to have the case dismissed on Friday afternoon.

Attorney Nicholas Alcock tells the newspaper they can no longer ethically represent their client and says it's outrageous that they have not received a manuscript or audiotape of the interview they call "exhausting":

He said the detective got up close and personal with Johnson, touching her leg, holding her hand and crying with her. The interview began with the officer telling her that he was her "friend," but became more combative and aggressive as it progressed, with the detective telling her that she could be facing the death penalty, according to Alcock.

Scottsdale woman charged in Baby Gabriel case gets attorney‎

Tammi Smith, 38, who has been charged in the case of missing Baby Gabriel, will receive a court-appointed attorney.

On Monday, Judge Paul McMurdie of Maricopa County Superior Court allowed Smith's previous lawyer, Amy Nguyen, who recently left the office of Kimerer and Derrick of Phoenix, to withdraw from the case.

McMurdie ordered the Office of Public Defense Services to appoint new counsel.

Smith, a Scottsdale resident, has a company, according to published reports, called the Healing Waters Health and Wellness Clinic. Tammi's husband, Jack Smith, 56, was once a big name in Southern gospel-music circles, according to reports that said he was a regular on the Grand Ole Opry, produced music for PraiseHymn Soundtracks and reproduced soundtracks for the Tape Factory.

The Smiths have one adopted daughter, Jack said recently. He said she is the child of a daughter from his first marriage. He also confirmed that he and Tammi are raising a second child from the same daughter.

The Smiths wanted to adopt Baby Gabriel, who lived with them for a week after Gabriel's mother, Elizabeth Johnson, fled from her Tempe home with him in mid-December. His father, Logan McQueary, 25, has not seen him since.

Her attorneys said a police interrogation by a San Antonio, Texas, detective in May was unauthorized and might have violated her rights and irreparably damaged her attorney-client relationship.

Attorney for Baby Gabriel's mom claims detective violated rights‎

Attorneys representing Elizabeth Johnson, the Arizona mother charged with kidnapping in the case of the missing 8-month-old baby Gabriel Johnson, have accused a San Antonio police detective of wrecking her defense by conducting an unauthorized interview with her.
Police Chief William McManus said the detective did conduct the interview May 10, three months after a police probe here led to a landfill search on the possibility that the baby was killed and thrown in the trash.

But McManus called the defense claims unsubstantiated and said the detective has not been removed from the case.

Arguing that the detective caused irreparable damage to their relationship with their client, attorneys Nick Alcock and Adam Feldman have asked a judge to dismiss the Arizona charges against the 24-year-old mother, who remains in the Maricopa County Jail in Phoenix.

A trial date for the Tempe mother of a missing baby is expected to be set by a Maricopa County Superior Court judge on Tuesday. He also will decide whether to dismiss the high-profile case.

During a hearing held in Judge Paul McMurdie’s courtroom on Wednesday, McMurdie set the hearing to determine when the trial of Elizabeth Johnson and Tammi Peters Smith will begin, stemming from a case of Johnson’s missing son, Gabriel, who was last seen Dec. 26 at a motel in San Antonio when she took him there in the midst of a custody battle.

Woman Trying To Adopt Missing Boy Also Waives Date

The mother of missing baby Gabriel Johnson and the Scottsdale woman who was trying to adopt him waived their scheduled court appearances Tuesday.

Elizabeth Johnson, Gabriel's mother, and Tammi Smith will next appear in court Nov. 22, where their court-appointed attorneys will be assigned, according to court documents.

Johnson and Smith are scheduled to go to trial May 9 to face criminal charges in the case of the missing child, who has not been seen since December 2009.

Johnson, of Tempe, is charged with kidnapping and Smith faces charges of forgery and conspiracy to commit custodial interference.
