Man accused on Daniel Morcombe murder back in court
THE man accused of murdering Sunshine Coast teenager Daniel Morcombe will remain behind bars after he makes his second court appearance in six weeks this morning.
Brett Peter Cowan, 42, is listed to appear in Brisbane Magistrates Court 18 after 9am to answer charges of murdering Daniel, 13, who vanished while waiting for a bus on December 7, 2003.
A Department of Justice spokeswoman said Cowan was listed for an "appearance required" mention of his five charges related to the sexual assault and murder of Daniel.
It remains unclear at this stage whether Cowan or his lawyers will ask that he be brought up from the George St court complex's holding cells for what is expected to be a relatively short hearing.
Last month chief magistrate Brendan Butler instructed Cowan be brought into court for the first mention of charges, despite Cowan's lawyers request he remain in the cells.
Sources have told The Courier-Mail Cowan has not yet made a Supreme Court application for bail because police were yet to provide an outline of the Crown case against him to either his lawyers or the Director of Public Prosecutions.
The sources said Cowan was charged without any outline of the alleged facts and that he would seek bail once police supplied details to his lawyers.
It is understood the DPP himself, Tony Moynihan, SC, will prosecute the case.
On August 15, Cowan turned away from the packed public gallery in Roma St's Magistrate Court 3 - an arrest court regularly used for defendants being held without bail.
Cowan's lawyer Tim Meehan at the time said he didn't require his client to be brought into the dock but Mr Butler instructed Cowan be placed in the glass-enclosed dock.
With a heavy police presence both in and outside the courtroom, Cowan - in jeans, a blue T-shirt and a watchhouse-issue jumper - sat barefoot and silent with his hands clasped.
Outside court, Mr Meehan said his client would be defending the charges.

Crown given months for Morcombe brief
The Crown has until the end of November to give lawyers for the man accused of murdering Queensland schoolboy Daniel Morcombe a full brief of evidence.
The case was mentioned in the Brisbane Magistrates Court on Monday.
Prosecutor Glen Cash said the brief was going to be fairly substantial.
"There are 70-odd statements ready to be delivered to the defence this morning," he said.
However, he requested until November 28 for the full brief to be handed over.
The request was granted by Magistrate Brian Hine, who set another mention date for December 12.

Search for Daniel's remains to end
The search for the remains of Daniel Morcombe in Sunshine Coast bushland is expected to be concluded next week, police say.
In a statement released today, Commissioner Bob Atkinson said the Morcombe family had been notified about the intention of police to end the search.
"The Queensland Police Service has talked with a range of experts who have been consulting on the search, and conducted an external peer review to ensure that best practice has been followed during the process,’’ he said.
"I acknowledge the police and State Emergency Service volunteers, who have worked tirelessly in incredibly difficult terrain.
"I am sure the people of Queensland are grateful for their unrelenting efforts in locating remains which have been DNA tested as belonging to Daniel."
At the conclusion of the search, police would provide a summary of what was located at the scene, Mr Atkinson said.
Daniel was last seen waiting for a bus under an overpass on Nambour Connection Road at Woombye on December 7, 2003 - just 12 days short of his 14th birthday.
The search for Daniel's remains began on August 13 this year in bushland at Beerwah, about 40 kilometres from Woombye.
Three bones were found on August 21, days after a pair of shoes were found at the site.
One week later, DNA analysis confirmed the bones were Daniel's. Forensic testing of the shoes - the same brand worn by Daniel when he disappeared - is still underway.
Last month, Daniel's father Bruce Morcombe told the media that the DNA confirmation had "traumatised" the family, but also brought some relief.
"It’s a place you don’t want to be but is a relief that perhaps we are at the final chapter," he said.
Daniel's mother Denise Morcombe said the family was determined to give Daniel a proper funeral.
"All of Daniel’s remains have to be found and then we can start planning a funeral," she said.

Police Commissioner Bob Atkinson on Friday said the Morcombe family had been advised of plans to end the search next week.
Three human bones, confirmed to be Daniel's, were discovered at the site in August. A pair of shoes of the brand Daniel was wearing when he disappeared are still being forensically tested.
More human remains were found last month.
'It's sad news because we'd always hoped we'd find some more of Daniel, but we really appreciate the extraordinary efforts by the police, the SES, volunteers and the public,' Mrs Morcombe told AAP.
'They've done everything that's humanly possible.
'And I think we're pretty lucky with what has been found.
'But it's just so hard.'

"If the defence counsel wish to do their own tests (on the evidence found), now is the time to do them and let Daniel be released to his family.
"At the end of the day, I think nearly every person involved (in legal process) is a parent ... and what we're saying is we just want to lay our boy to rest.
"That might seem a simplistic way of dealing with it, but that's our position."
Their lawyer Peter Boyce said the Morcombes would know within weeks.
"I think (the DPP) will tell us within a few weeks or he might even tell us at that meeting," Mr Boyce said.
"It depends on whether they've done all the forensic testing they want to do and whether they're satisfied those tests are sufficient.
"The last thing they'd want to do is release his remains and then have an argument about whether the testing was done properly," he said.
